The impoundments will be used to <br />contain storm water that comes in contact with the <br />affected area. <br />A) Are these ponds going to be part of the Storm <br />water management plan approved by the CDOH&E? If <br />such is the case, DMG will require the dimensions <br />of these ponds for financial warranty calculation <br />purposes (Backfilling, grading and seeding). Only <br />one pond is indicated in the maps provided in the <br />application. <br />B) The Rule requires the depth and thickness of the <br />deposit to be mined and the thickness and type of <br />overburden to be mined. Please provide the <br />information as required in Rule 6.4.4 (f) (i) <br />Exhibit "E" Reclamation Plan <br />Under the reclamation plan operator states, "Mine <br />slopes will generally be excavated to a 1:1 slope. <br />Excess material will then be deposited at the toe of <br />the slope to obtain a 2:1 slope or better. The <br />Division has found thru the years, slopes steeper <br />than 3:1 will have erosion problems and recommends a <br />3:1 slope or better for post mining land use. If the <br />operator can demonstrate 2:1 slopes in this alluvium <br />deposit will be stable, the Division will accept <br />such engineering demonstrations as proof. <br />Exhibit "G" Water Information. <br />It is the understanding of the Division, that the <br />mining operation will not intercept ground water. <br />All the water needs for the operation will be <br />through the use of a commercial well that will be <br />applied for and permitted by the State Engineer. <br />Since the planned operation is dry, the Division <br />does not anticipate impacts to the ground water from <br />the operation to adjacent domestic wells with in 600 <br />feet of the permit area. The only change to the <br />existing operation under this amendment is, the <br />affected acreage will expand from the existing 39 <br />acres to 50 acres, an increase of 11 acres. Under <br />the previous 112 permit, the operator had an <br />existing ground water well that was utilized for <br />water use on site, under the amendment application, <br />the operator plans to apply and obtain another well <br />permit and abandon the existing well. <br />It is also the understanding of the Division that <br />the operator plans to obtain an NPDES permit for all <br />surface water discharges if any from the affected <br />lands. <br />
