It appears that the construction of a slurry wall azound Longhorn and Shazkey's Lakes will cross a <br />number of gasloil lines on the property. The operator will need to demonstrate that such gasloil lines <br />will be stable with the construction of the proposed slurry wa1Ls in the form of an engineering <br />evaluation, or provide a notarized agreement from the owners of the structures and Platte Sand and <br />Gravel, LLC. that meets the requirements of Rule 6.4.19 and Section 34-32.5-115(4)(e), C.R.S. <br />Please be aware that if any of the gasloil lines need to be relocated as a result of the mining and <br />reclamation operation, then a notarized agreement between the operator and the owner of the <br />structure must be obtained prior to approval of the application. <br />l3. Attached, please find a letter from Duke Energy regarding the amendment application. The Division <br />spoke with Lew Hagenlock on July 8, 2004 regazding the high-pressure natural gas lines adjacent to <br />the site. Mr. Hagenlock stated that this letter was not intended as an objection to the application, <br />only that if any pipelines aze to be relocated then the operator must reach a reimbursement <br />agreement with Duke Energy. As stated above, if any of the gas lines need to be relocated as a result <br />of the mining and reclamation operation, then a notarized agreement between the operator and the <br />owner of the structure must be obtained prior to approval of the application. <br />Please be advised that the S & H AM-O1 Application may be deemed inadequate, and the application <br />may be denied on August 23, 2004 unless the above-mentioned adequacy review items are addressed to <br />tine satisfaction of the Division. If you feel more time is needed to complete your reply, the Division can <br />giant an extension to the decision date. This will be done upon receipt of a written waiver of your right <br />to a decision by August 23, 2004 and request for additional time.
