Division of Minerals and Geology <br />March 31, 2003 <br />Page 4 of 17 <br />that according to Rule 1 Section 1.3 (3) an operator may only mark as confidential information <br />disclosing the location, size or nature of the deposit or depth and thickness ofthe deposit and <br />thickness and type of overburden to be removed. All other information required by the <br />regulations can not be kept confzdential. <br />Response: <br />Since the amendment application was originally submitted the Mine Plan has been revised and <br />updated as of 1/1/03. Attached is "Table D-1: Mine Planning Details", marked as "Confidential <br />Information", that shows the general mining plan based on the cuts for the life of the quarry. The <br />table shows the cuts and approximate years that each cut will be initiated. There will be some <br />overlap in activities in certain cuts throughout the years to allow for stripping of overburden and <br />also to minimize the impact to neighbors (i.e. -approximately 750 feet of the eastern portion of <br />cuts 5, 7, and 4 will be left until year 2016 when the quarry face will be parallel to and will <br />advance towards L street on those specific cuts. The same will occur with cuts 11 and 14 in the <br />later years. <br />It is planned that the backfilling of Cut 1 will start in 2004 after the limestone has been removed. <br />Backfilling, starting from the south, will take place on a continuous basis, starting in 2004 and <br />proceeding throughout the life of the quarry. Reclamation will commence once sufficient <br />backfilling has occurred and a substantial area has been completed to grade. The area will then <br />graded to contour, covered with topsoil and seeded according to the approved seed mixture. <br />Item No. 7 <br />DMG.~ During the pre-operation inspection conducted on October 10, 2002, the need for <br />sediment control in the Bear Creek mining area was discussed. The division suggested that a <br />sediment retention dam (pond) could be constructed on or near the lower reach of the creek <br />within the permit area to prevent silt from being deposited on land outside the affected land <br />boundary or from degrading water quality downstream ofyaur operation. Please provide a <br />sediment control plan including designs for any structure/s, for the Bear Creek drainage/mining <br />area. <br />Response <br />Holcim will insure that any water that flows over the disturbed area is contained within the <br />disturbed area and channeled to an area where the water can be managed during quarry <br />operations. In the area near Bear Creek, Holcim will install Best Management Practices (BMP's <br />- e.g. silt fencing, hay bales, and small attenuation basins off of main channels) to insure that any <br />water that has the potential to flow into the Beaz Creek Drainage wilt be attenuated prior to <br />reaching Bear Creek. <br />Item No. 8 <br />DMG: In accordance with Rule 6 Section 4.4 (e), you have provided a timetable for the mining <br />operation. However, this section also requires that the timetable establish the relationship <br />between mining and reclamation. Please provide a detailed description, including timeframes, of <br />how reclamation will follow mining. In particular the Division wants Holcim to commit to <br />completing final reclamation, topsoiling and revegetation, in a timely manner.
