Heffner Dfrecfar <br />Southwestern Ecological Services <br />37 Easi Colorado Avenue <br />Denver, CO. 80210-3105 <br />RE: ARAPAHOE COUNTY REQUIREMENTS FOR THE SCHMIDT <br />CONSTRUCTION COMPANY -COAL CREEK RESOURCES <br />OPERATION AMENDMENT FOR COLORADO MINED LAND <br />RECLAMATION PERMIT; RECLAMATION PERMIT M-1988-044 <br />Deaz Mr. Heffner: <br />As a follow-up to our telephone conversation on December 22, 2005 concerning the <br />application submitted to the Colorado Mined Land Reclamation Boazd for Schmidt <br />Construction Company, I can provide the following information. <br />The application submitted to the Mined Land Reclamation Boazd is for a Regulaz (112) <br />Construction Materials Extraction Operation Permit on 1,650 acres located in <br />unincorporated Arapahoe County in all or portions of Sections 13, 24, and 36 of <br />Township 5 South, Ran~e 65 West; and in Sections 18 and 19 of Township 5 South, <br />Range 64 West of the 6 P. M. The property is more generally located south of East <br />Quincy Avenue and east of County Road 241 (extended), on property owned and <br />managed by the Colorado State Land Board as part of the Lowry Range. <br />The property is zoned by Arapahoe County as Agricultural (A-1), and is subject to the <br />Zoning Regulations of the County. Under the "A-1"zone district, mining, quarrying and <br />earth extraction industries subject to Section I-3600 (enclosed), and a Use by Section <br />Review application (Section 1-1605, enclosed). <br />The Use by Special Review process is explained in Section 5600 (enclosed) and includes <br />a formal application and application fees, public referral period, and a noticed public <br />hearing and decision before the Board of County Commissioners. This is a four to six <br />month process from date of formal application to public hearing before the Board. The <br />enclosed flowchart outlines the complete process. <br />The application process begins with aPre-Submittal Meeting with a County planner and <br />engineer.
