Ms. Jennifer Lindahl <br />Larimer Pit, M-74-069 <br />April 18, 2000 <br />Page 2 <br />after Barnes credits during July through October, will be met by releases of C-BT water <br />owned by Loveland Ready Mix. At a quota of 0.5 acre-feet per unit, the 60.7 units <br />committed to this plan will provide up to 30.35 acre-feet of replacement credit. The C-BT <br />units are approved for use in this temporary substitute water supply plan. <br />I hereby approve the extension of this substitute water supply plan in accordance <br />with §37-80-120, C.R.S. subject to the following conditions: <br />1. All conditions listed in the original approval letter remain in effect, except as <br />modified below. A copy of the original approval is attached for your reference. <br />2. The total surface area of the groundwater exposed after December 31, 1980 <br />must not exceed 22.89 acres during this approval through February 28, 2002. <br />The water used for concrete batching must not exceed 15.32 acre-feet per <br />year, the water lost with mined product must not exceed 2.08 acre-feet, and <br />the water used for dust suppression must not exceed 5.40 acre-feet per year. <br />Should the total water surface area at the pit, or the amounts of water used for <br />concrete batching, dust suppression or lost with mined product exceed these <br />amounts prior to the expiration date of this plan, an amendment will need to be <br />filed with this office. <br />3. Adequate accounting of diversions, cubic yards of concrete batching, tons of <br />mined product, water used for dust suppression, and replacements must be <br />provided to the Division Engineer (800 8th Avenue, Suite 321, Greeley, <br />Colorado 80631) and the Water Commissioner (Don Brazelton, 1 159 North 1 ~` <br />Avenue, Greeley, Colorado 80631, (970) 352-2151) on a monthly basis or <br />other ~riterval oCCeptabia tv by^th of the^1T. Ti12 aCCGUil tidy' fGim prGVlded vJltii <br />your application is subject to modification and approval by the Division <br />Engineer. Ali amounts shall be in acre-fee±, except concrete batching which <br />shall be in cubic yards, and mined product, which shall be in tons. <br />4. Approval of this plan is for the purposes as stated herein. This office must first <br />approve any additional uses for which the water may be used. <br />5. The replacement water, which is the subject of this plan, cannot be sold or <br />leased to any other entity. As a condition of subsequent renewals of this <br />substitute water supply plan, the replacement water must be appurtenant to <br />this site until a plan for augmentation is obtained. A copy of this approval letter <br />should be recorded with the county clerk and recorder. All replacement water <br />must be concurrent with depletions in quantity, timing and location. <br />6. This substitute water supply plan may be revoked or modified ai any time <br />should it be determined that injury to other vested water rights has occurred or <br />will occur as a result of the operation of this plan. <br />
