Ms. Jennifer Lindahl <br />Lorimer Pit, M-74-069 <br />April 18, 2000 <br />7. All gravel mining operations that result in a permanent free water surface (i.e., <br />exposed ground water) will be required to obtain a court decreed augmentation <br />plan, and a decree for a permanent augmentation plan will be required within <br />three (3) years of the date of mining is completed in such operations unless <br />specific reasons warrant an extension. <br />8. The required 44.8 acres of dry up of land formerly irrigated acreage by the <br />Barnes Ditch water shall be monumented to the satisfaction of the water <br />commissioner and a legal description and dry-up covenant shall be recorded <br />with the county clerk and recorder. <br />9. The approval of this plan does not imply a position by our office on any <br />litigation associated with this case. <br />10.This plan shall be valid through February 28, 2002, unless otherwise revoked or <br />modified. If a plan for augmentation is not obtained by the plan expiration date, <br />a valid substitute water supply plan is required. <br />11 .Acceptance of these conditions will be assumed unless a letter to the contrary <br />is received by this office within two weeks after receipt of this letter. The <br />name, address and phone number of a contact person who will be responsible <br />for the operation and accounting of this plan must be provided to the Division <br />Engineer and the Water Commissioner within two weeks after receipt of this <br />letter. <br />Page 3 <br />This office does not condone the eradication of native wetland vegetation. <br />Llkevvlse, approval of this plan does not satisfy any federal laws or regulation and liability <br />resulting therefrom.
