All gravel mining operations that result in a permanent free water surface (i.e., exposed ground water) will be required to obtain a court decreed augmentation plan, and a decree for a permanent augmentation plan will be required within three (3) years of the date of mining is completed in such operations unless specific reasons warrant an extension. 8. The required 44.8 acres of dry up of land formerly irrigated acreage by the Barnes Ditch water shall be monumented to the satisfaction of the water commissioner and a legal description and dry-up covenant shall be recorded with the county clerk and recorder. 9. The approval of this plan does not imply a position by our office on any litigation associated with this case. 10.This plan shall be valid through February 28, 2002, unless otherwise revoked or modified. If a plan for augmentation is not obtained by the plan expiration date, a valid substitute water supply plan is required. 11 .Acceptance of these conditions will be assumed unless a letter to the contrary is received by this office within two weeks after receipt of this letter. The name, address and phone number of a contact person who will be responsible for the operation and accounting of this plan must be provided to the Division Engineer and the Water Commissioner within two weeks after receipt of this letter.
