MINING PLAN <br />Line 9 is the amount of additional land that can be disturbed without being out of <br />compliance with the bonded area in the permit AND the limitations on disturbance at any one <br />time set in the lease. <br />If the amount in line 9 came from Line 8 then the amount in Line 9 can be increased by either <br />eliminating land in roads or reclaiming and seeding land included in Line 2. <br />If the amount in line 9 came from Line 3 then adding more bonded land, through a technical <br />revision, to the amount of land in Line 3 will provide more disturbance area up to the limit shown in <br />the amount of acres in Line 8. <br />In some situations, it may be necessary to add more bonded land AND reclaim and seed <br />already disturbed land to provide sufficient land for continued operations. <br />REQUIREMENT: It is the operator's responsibility to insure that bonding includes <br />not only all land currently affected and land to be affected in the near future, but also to insure <br />that the 150 acre lease limitation is not exceeded. <br />Although this is complicated, this method reduces the bond cost and maintains consistency <br />with both permit and lease requirements. This approach is unusual, but appeazs to be the only <br />approach, considering the nature of the deposit and the many variables in the reclamation process, to <br />achieve the overall and primary goal of upholding the requirements of the Stewazdship Trust <br />classification of the property. Compliance with these requirements will be evidenced by both the <br />Reclamation Permit annual report and the Annual Status Report to the Colorado Boazd of Land <br />Commissioners. As described elsewhere, each agency will receive not only their own report, but the <br />other agency's report as well. This will allow all parties to be fully informed regarding the status of <br />the operation with respect to both the lease and the permit. <br />Phasing of the Operation <br />The operation is divided into two phases (Exhibit C-1). The North Phase includes the land <br />northward from the principle large tributary that extends eastward from Coal Creek. In this plan the <br />valley associated with that tributary is called the East Valley. The South Phase includes primarily <br />Section 36 on the southern end of the site, but also includes other leased and permitted lands on the <br />southern 2/5 of the entire site. <br />This phasing is done for several reasons, but primarily is based upon an assessment of the <br />existing condition of the land. As described primarily in the vegetation information exhibit in this <br />amendment application, Section 36 and parts of Section 25 are fairly distinctive when compared to the <br />rest of the property.
