MINING PLAN
will be by means of technical revisions. Similarly, bonded land will be released as the reclamation is
completed.
REQUIREMENT: No land outside the bonded boundary may be disturbed without
f-rst bonding that land. Requests for additional bonding land will be made a minimum of 30 to
60 days prior to the time it is needed to provide for sufficient processing and review time.
But there is an additional complicating factor that must be considered in this bonded area. The
lease requires that no more than 150 acres of mining activity be disturbed at any one time. This 150
acres does not include access roads or land that has been final graded AND placed in final
revegetation status with seeding. Therefore, this leased acreage limitation applies only to processing
facilities, actual mining pits, and disturbances associated with the mining pits. However, bonding
must include all affected ]and. Therefore, the bonded land maybe considerably larger than the 150
acre limitation land. But there must be compliance with both limitations.
REQUIREMENT: The bonded land may exceed the 150 acre value in the lease, but in
no case will the land defined as being in the 150 acre lease limitation exceed 150 acres.
An Example of how to account for both limitations:
Example of Disturbance Category Calculations
Description of Land Category acres
Line 1 Total amount of land bonded (Bonded Boundary) 280
Line 2 Land area actually disturbed in Bonded Boundary 250
Line 3 Land bonded but undisturbed (Line 1 minus Line 2) 30
Line 4 Bonded land contained in roads 75
Line 5 Bonded land seeded but not released from bond 55
Line 6 Total excluded land (Line 4 plus Line 5) 130
Line 7 Total land allowed in Land Board disturbance category
(this is a fixed value) 150
Line 8 Additional disturbance allowed in Land Board
disturbance limitation (Line 7 minus Line 6) 20
Line 9 Enter the smaller of Line 3 or Line 8 20
Coal Creek Sand Resource Amendment 3 (2005) - M-1988-044 Exhibit D Page 13
