MINING PLAN <br />5. Mining in or adjacent to known, identified wildlife habitat locations will only occur after <br />full consideration of the impacts on wildlife. <br />See page 15. <br />6. No mining or deposition of overburden or other disturbances that can cause significant <br />damage to the surface or the existing vegetation can occur within 100 feet of the nearest edge of <br />the normal flow channel of Coal Creek. The 100 foot setback will be determined by the flow <br />channel location at the time that mining will occur in nearby areas. This is roughly shown on <br />the maps, but will be further defined as the need arises. Once defined, the setback will be <br />clearly marked with markers and the markers maintained. <br />See page 16. <br />7. No mining will occur within 100 feet of living cottonwood stands or single, living isolated <br />cottonwood trees. If the trees occur within the flow channel of Coal Creek (very rare) then the <br />Stream Channel Setback will apply. When the trees occur outside the flow channel (more <br />normal) then this setback determines the limit of mining adjacent to forest and stream. <br />See page 17. <br />8. Within land affected by this operation, driving off of designated roads and access corridors <br />will be prohibited, if that land contains significant noxious weed growth. Land shown as being <br />infested by noxious weeds on the most current version of Exhibit C-6 are considered to have <br />significant noxious weed growth. If in doubt check. THIS REQUIREMENT APPLIES TO ALL <br />VEHICLES, PRIVATE OR GOVERNMENT, THAT ENTER LAND AFFECTED BY THE <br />MINING ACTIVITY. This shall not be construed to limit activities of other lessees on this <br />property or ordnance removal work. But within all affected land, this requirement applies to all <br />parties. It is hoped that a policy similar to this will be implemented for all parties entering this <br />land, but that is not this operator's responsibility. The applicant and lessee has no right to limit <br />access by other lessees and will therefore not be responsible for damages created by other <br />lessees or the impact of the actions of other lessees within lands that have not been affected by <br />this operation. Affected land shall include all mining land, all land used for processing and <br />stockpiling, and all land in the process of being reclaimed. <br />See page 18. <br />9. No mining or other disturbance that will disrupt the surface of the land can occur within <br />200 feet of existing gas or oil wells, oil or gas pipelines, or water wells or waterlines. Affecting <br />land closer than 200 feet is only allowed after permission is obtained from the well or pipeline <br />owner and the additional disturbance is also approved by the Colorado State Board of Land <br />Commissioners and the Division of Minerals and Geology (or Mined Land Reclamation Board). <br />This also applies to overhead power lines with respect to mining but not necessarily other uses <br />of the land in the mining operation. Driving over buried pipelines (oil, gas, or water) will be <br />allowed on established roadways. In the event temporary access roads must be created that <br />cross a buried line, confirmation that driving over the pipeline is safe will be obtained prior to <br />using the access route. Safety with respect to crossing under overhead lines will always be <br />observed.
