accordance with the approved plan. Please update the Division as to the status of armoring of the <br />riverside of the South Platte River. Please be aware that the operator is required to armor the pit side <br />banks once 500 feet of final shoreline has been created prior to April ls` of each year. <br />Please be aware that the cost to install armoring will need to be included in the reclamation cost <br />estimate due to the change in the mining configuration and proximity to the South Platte River. As <br />noted in the AM-O1 bond estimate, the cost for armoring 1,000 feet of exposed shoreline with riprap <br />material is $238,250.00. This cost was also agreed to by the operator in a letter dated May 22, 2001 <br />from Environment Inc. <br />7. The operator states that they are aware that the liner cannot be installed until approval of the liner is <br />received from the Division of Minerals and Geology. Please be aware that AM-01, which revised the <br />mine plan to install a slurry wall liner, has been rescheduled for reconsideration due to failure to post <br />the bond within 1-year of the amendment approval. The notice of reconsideration was submitted <br />under sepazate cover. <br />8. The Division revised the reclamation cost estimate to reflect a maximum disturbance of 65 acres. The <br />Division retained the cost for dewatering due to the possible need to facilitate reclamation of the pits <br />in order to achieve a 3h:ly slope 5 feet above to 10 feet below the groundwater, and 2h:ly for the <br />remaining slopes. Tn addition, the Division included a cost to install riprap as noted above. <br />Therefore, the revised cost to reclaim the site totals $460,000.00. Please see the attached estimate for <br />further detail. The Division will require that the remaining bond ($348,500.00) be posted within <br />60 days of receipt of this letter. <br />Please be advised that TR-03 Application may be deemed inadequate, and the application maybe denied <br />on October 31, 2005 unless the above-mentioned adequacy review items are addressed to the satisfaction <br />of the Division. If you feel more time is needed to complete your reply, the Division can grant an <br />extension to the decision date. This will be done upon receipt of a written waiver of your right to a <br />decision by October 31, 2005 and request for additional time.
