Cottony <br /> Division Director <br />RE: Platte Sand & Gravel LLC, File No. M-2000-158 Natural Resource Trustee <br />S & H Mine; TR-03 Application Adequacy Review <br />Deaz Mr. Hoffschneider, <br />The Division received Technical Revision 03 (TR-03) for the S & H Mine, Permit Number M-2000-158. <br />The Division of Minerals and Geology (Division) is required to make an approval or denial decision no <br />later than October 31, 2005, therefore, your response to the following adequacy review concerns should <br />be submitted to the Division as soon as possible. <br />Rule 6.2.1(2) requires that maps be signed by a registered land surveyor, professional engineer, or <br />other qualified person. Figure TR-1 was not signed. Please resubmit a signed copy of the map. <br />Office of <br />Active and Inactive Mines <br />2. Per Rule 6.3.3(g), please specify the location and dimension of all haul roads that will be used during <br />the life of the mining operation. Any improvements necessary on existing roads and the <br />specifications to be used in the construction of the new roads needs to be described in the permit and <br />included as part of the permitted acreage. The applicant will also need to address reclamation of any <br />new or improved roads constructed on site. Please specify the construction methods, dimensions and <br />the drainage/runoff conveyance structures of all new and upgraded roads. Also, please provide <br />information regazding the design of the ditch crossings so that they may be included in the <br />reclamation cost estimate. <br />3. Please submit the surface use agreement between Platte Sand & Gravel LLC and Kerr-McGee that <br />contain notarized documents in accordance with Rule 6.4.19(a) or Rule 6.4.19(c). Alternatively, the <br />Operator may provide an engineering plan for each proposed utility crossing for which an acceptable <br />notarized document is not obtained. <br />4. Please inform the Division as to how topsoil piles will be protected to prevent wind and water erosion <br />and include the dimensions of the piles and a temporary seed mixture. Please state the proposed seed <br />mixture, the rate in PLS/acre, the application method and timing of seeding. In addition, please <br />depict the location of all future topsoil and overburden piles to be constructed on site. <br />5. The operator depicts a topsoil pile on Map Exhibit C-1-TR. Overburden piles were not noted on the <br />map. Please be awaze that topsoil will need to be segregated and stored separately from the <br />overburden material as required by Rule 3.1.9(1). Please locate all current and future overburden <br />piles on the mine plan map. <br />6. Based on the revised mining plan map, it appears that mining has taken place within 400 feet of the <br />South Platte River. According to the approved plan, at no time will mining take place within 400 feet <br />of the river without first having armored the banks on the riverside that aze subject to erosion and less <br />than 400 feet from the excavation area.
