No mining shall occur within the Xcel right-of--way, within 200' of the Xcel. towers, or within 200' of the within 200' of East 104`h Avenue right-of--way. 4. No mining shall occur within 35' of any on-site United Power power pole without approval by the DMG of an Agreement with the United Power. No mining shall occur within 65' of the inside top east high bank of the Fulton Ditch without approval by the DMG of an Agreement with the Fulton Irrigating Ditch Company. 6. No mining shall occur within 200' of the South Adams Water and Sanitation District sewer line without approval by the DMG of an Agreement with the South Adams Water and Sanitation District. No raining shall occur within 200' of the property to the east and north of the Xcel right-of- way (Topper) without approval by the DMG of an Agreement with this property owner. No mining shall occur within 200' of property to the east and south of the Xcel right-of--way (Gibson) without approval by the DMG of a Slope Stability Analysis for a lesser setback. Prior to installation of the conveyor and pipe crossing across the Fulton Ditch, an Agreement acceptable to the DMG with the Fulton Irrigating Ditch Company will be obtained. 10. No dewatering shall be undertaken without an Agreement with shallow well owners within 600', or the State Engineer's Office (SEO) approves partial dewatering, and the written agreements or approval from the SEO for dewatering to a maximum depth of 15 is reviewed and approved by the DMG. 11. No mining shall occur within 2' of the groundwater table in any area not already exposed to the surface until the State Engineer's Office (SEO) approves a substitute water supply plan or another plan that allows such exposure of groundwater.
