Prior to any disturbance being undertaken, proof of amendment to existing S WNIl' Permit, <br />or the obtaining of new 5WMP Permit shall be submitted to the DMG. <br />13. Prior to any disturbance being undertaken, a revised Spill Prevention Control Plan with the <br />addition of the below language shall be submitted to the DMG. <br />"A reportable spill is a spill of any toxic or hazazdous substance (including spills of petroleum <br />products) within the permit area reportable to any Division of the Colorado Department of <br />Health and the Environment, the National Response Center, the Colorado Emergency <br />Planning Commission, a local Emergency Planning Commission , or the State Oil Inspector. <br />The operator shall notify the Office of a reportable spill within the permit area using the same <br />time frame required by the permit, license, notice, Act, Rule, or Regulation governing the <br />reporting of the spill to the appropriate agency. Notice of a reportable spill shall be Faxed to: <br />Minerals Program Supervisor, Division of Minerals and Geology, FAX (303) 832-8106. The <br />FAX shall include acal]-back number of a responsible company official for the DMG staff to <br />use as a contact." <br />14. No dewatering or extraction activities will occur until Aggregate Industries develops a plan <br />to monitor the gravel pond water for diisopropylmethylphosphonate (DIl~]P) and obtains <br />approval of that plan from the DMG. The plan will include monthly sampling and analysis <br />to begin immediately after dewatering and/or extraction activities are started. The monthly <br />monitoring will continue for one year and then change to quarterly monitoring, until the DMG <br />issues a letter authorizing discontinuance. The plan will include sampling and analytical <br />methods to be used and an agreement to submit the results ofthe analysis to the DMG within <br />30 days of the sampling date. The samples will be obtained and analyzed by a company, <br />individual, or agency certified to do the work. If an analysis shows a level of DIIvIP <br />exceeding 8ug/L, Aggregate Industries or it's agent will immediately notify the DMG by <br />certified mail and include a response plan to deal with the contaminant, and to prevent on-site <br />and off-site damage. If the DMG determines from the monitoring data that there is a <br />reasonable potential for the operation to cause groundwater quality standards for DIMP to <br />be exceeded, the DMG will notify Aggregate Industries to modify the permit as necessary to <br />comply with Subsection 3.1.7 of the Rules. <br />
