Aaalication for Conversion of a Section 110c Limited Imaact (9.9 acre) <br />Reclamation Permit to a Section 112c Reealar (89 acre) Reclamation Permit <br />Everist Materials, L.L.C., Mascot Placer, File No. M-1998-052 <br />Board Hearing <br />In accordance with Rule 1.4.9(2)(a) of the Construction Materials Mining Rules and Regulations <br />of the Mined Land Reclamation Board (rules), whenever an objection to a 112 reclamation <br />permit application is Sled with the Division of Minerals and Geology (DMG), the matter is set <br />for a hearing before the Mined Land Reclamation Board (Board). A hearing has been scheduled <br />for the Mascot Placer during the June 22-23, 2004 Board meeting beginning at 10:00 a.m, on the <br />22"d and 9:00 a.m. on the 23`d, and will be held in room 318 of the Centennial Building, 1313 <br />Sherman Street, Denver Colorado. The date for the hearing on the Mascot Placer, whether it will <br />be Tuesday the 22"d or Wednesday the 23`d, will be established u~on issuance of the final <br />meeting agenda. Contact the DMG at 303-866-3567 on June 18` or June 2151 to find out what <br />day the hearing will be held. <br />DMG Recommendation <br />The date for DMG consideration of the Mascot Placer application has been established in <br />accordance with rule 1.4.9(1) as June 14, 2004. On this date, the DMG must issue a <br />recommendation to the Board for approval, approval with conditions, or denial of the <br />application. DMG has reviewed the application, as modified through the DMG's adequacy <br />review process, within the scope of the Colorado Land Reclamation Act for the Extraction of <br />Construction Materials (Act), §34-32.5-101 et. seq., C.R.S., and hereby recommends approval of <br />[he Mascot Placer conversion application without conditions. <br />Issues Raised during DMG Review <br />In accordance with Rule 1.4.9(2)(c), the following listing is provided of the issues raised by the <br />DMG in the review of the conversion application for the Mascot Placer and a summary statement <br />describing the resolution of each issue. <br />DMG Issue #1: The conversion application contained no commitments to establish vegetation in <br />the area to be affected by dredge pile removal. The DMG recognizes that there is no topsoil or <br />other viable plant growth media located within the 42 acre area to be excavated. However, It is <br />DMG's position that the gravel surface that will remain following excavation of the dredge rock <br />can be feasibly treated to provide for plant growth, and that surface preparation, seeding and <br />planting be employed. Although importation and application of natural soil viable as a plant <br />growth medium will provide the best potential for vegetation success, the Act provides no <br />authority to require soil importation. As a result, the DMG recommended that Everist consider <br />organic soil amendments, mulch, and use of inorganic processing fines to build a soil suitable for <br />plant growth. The DMG further recommended planting of willow shoots in site perimeter berms. <br />
