If your District were a landowner or easement holder, you may have been entitled to <br />notification of the Sokol Amendment. If that is the case, you should immediately notify the Division and <br />provide evidence of your status as a landowner or other owner of record. <br />Your issue about the Applicant's possible use of their alluvial well No 115606 for gravel washing <br />purposes is one that you should take up with the Division of Water Resources. Whether they maybe in <br />violation of their well permit is outside the jurisdiction of the Division. <br />In your petition for party status, which we provided to Tyson Powell, the Boazd's Attorney, you laid out <br />objections to the application. It is the Division's position that these objections were not timely, and we <br />will not formally introduce them to the permitting process unless the Boazd decides differently. In the <br />meantime, the applicant has filed an objection to your petition -see letter attached. <br />Although your objections were not filed timely, we considered them nonetheless and determined that all <br />of the issues either were addressed substantially already by the Division's adequacy review, or that they <br />are within the authority of the Division of Water Resources.
