One letter <br />requested an explanation as to why the Upper Black Creek Ground Water Management District (District) <br />was not notified of the Sokol Pit Amendment. The other, a petition to the Mined Land Reclamation <br />Board (Boazd) for Party Status to the upcoming hearing, contained objections and an attachment that <br />appears to describe the District's purpose and legal authorities. I will attempt address the Division's <br />position regarding both documents in this lt;tter. <br />Requirements for public notice of new permit applications and amendments are described in section 1.6 of <br />the Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board for the Extraction of <br />Construction Materials. The obligations of the Division of Minerals and Geology (the Division or the <br />Office) and the Applicant or Operator to notify certain agencies and entities aze identified in this section. <br />The Rules require that either the Division or the Applicant send notice of the proposed operation to the <br />County within which the operation is to be located, municipalities within 2 miles, the Boazd of County <br />Commissioners, the Boazd of Supervisors of the Soil Conservation District if the proposed operation lies <br />within such a district, owners of record of all surface and mineral rights of the affected land, and owners <br />of record of all land surface within 200 feet of the boundary of the affected lands. Notice of the proposed <br />operation is to be posted at the site and published in a newspaper of general circulation in the locality of <br />the proposed mining operation. A copy of the proposed permit or amendment is to be posted at the <br />County Clerk and Recorders Office. In addition, during the adequacy review period, the office may <br />designate other owners of record who may be affected by the proposed mining operation, and thus compel <br />the applicant to notify such owners of record. This includes, for instance, owners of record of easements <br />and of permanent manmade structures. <br />In addition, the Division issues notices to other agencies either by policy, by any of several Memoranda of <br />Understanding, or by prior request agreed to by the Division or the Board. These include, but may not be <br />limited to the Division of Wildlife, Division of Water Resources, CDPHE (Air Pollution Control Unit; <br />Office of Office of Colorado <br />Mined Land Rxlamation Active and Inactive Mines Geotogiwl Survey <br />
