The basis for this petition was the fact that they were <br />not notified as an interested parry to the permit process. <br />At this time I would like to file our objection to this petition. The rules and regulations of the <br />DMG do not require notification of special districts during the t 12 Permit process. As well, <br />they had ample time under the public comment periods to voice their objections. They did <br />not express their objections in a timely manner as required by the law. They also claimed <br />that they were unaware of the proceedings until the week of January 2, 2006. We believe <br />that this information is incorrect. On October 5, 2005, Dave and Tracy Doran spoke to the <br />DMG about their concerns with this application. It has been brought to our attention that <br />Tracy Doran is registered with the State of Colorado as the official contact person for the <br />Upper Black Squirrel Creek Ground Water Management District. The Doran Family first <br />made contact with your office on October 5, 2005 to lodge their first complaint about <br />publicizing notifications in reference to this permit. Therefore, Tracy Doran was well aware <br />of these proceedings and could have informed the water district and allowed them plenty of <br />time to comment. As well, the water district had plenty of time to comment after the <br />notifications were published in the Gazette Telegraph and the Ranch Land News. We feel <br />that the Upper Black Squirrel Creek Ground Water Management District had more than <br />ample time to comment on this permit and failed to meet the requirements of the DMG rules <br />and regulations.
