14. The stratum below the material to be mined is .Pierre Shale claystone bedrock. This <br />information has been added to the cross-section on EXIIIBIT F SHEET 2 of 2, and the text <br />in EXHIBIT D. - <br />15. Maximum backfilling will be 6" above the existing lake elevation level, which generally occurs <br />in the June-July time period each year, to create wetlands. This standard has been added to <br />EXHIBIT C-2 SHEET 2 of 2, and of the text in EXHIBIT D AND EXHIBIT E. <br />16. The existing Dischazge Permit will be amended to include the Amendment No. 1 area, before <br />any discharge activities aze initiated from the amendment area. This statement has been added <br />to the text in EXIIIBIT D, EXHIBIT G, and EXHIBIT M. <br />17. The Spill Management Plan will be amended to include your suggested additional language, <br />and this commitment has been added to the text in EXHIBIT D. <br />18. No mining is proposed within 200' of 104' Avenue, and no mining will also be allowed within <br />200' of the Topper property fence without an agreement with this property owner acceptable <br />to the DMG, within 65' of the Fulton Ditch without an agreement with the Ditch Company <br />acceptable to the DMG, within 35' of the United Power power poles along the Fulton Ditch <br />without an agreement with United Power acceptable to the DMG,- or within 200' of the <br />eastern property line south of Xcel right-of--way without submission of a Stability Analysis <br />detemtining a lesser setback acceptable to the DMG .All of these changes have been included <br />on EXHIBIT C-2 SHEET 2 of 2 MAP and the text in EXHIBIT D, EXHIBIT M, and <br />EXHIBIT S. <br />19. The reclamation details from EXHIBIT J have also been to the text in EXHIBIT D and <br />EXHIBIT E. <br />20. The amount of acreage accorded to dry land revegetation acreage has been stated in the text <br />of EXHIBIT E and added EXHIBIT F SHEET 1 of 2. <br />21. See item #15 above. <br />22. DIMP is a pollutant that was released in minute quantities from the Rocky Mountain Arsenal. <br />The Army tested all shallow wells throughout the area, and affected well owners were hooked <br />up to public water supply several years ago. According to the South Adams Water and <br />Sanitation District, Ms. Topper's wells was not within the area of the DIMP plume and <br />therefore her wells were not hooked up. Since that time, the DIMP plume has been further <br />reduced to just a small area that is 3 miles east of Ms. Topper's property. This information <br />is.included to the text in EXHIBIT F. <br />23. See item #10 on page 2. <br />
