<br /> <br />STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF: Castle Concrete ) MODIFICATION OF BOARD ORDEf: FOR <br />Company, Snyder Quarry, ) CORRECTIVE ACTION PLANS FOF; <br />File No. M-77-210 ) NOTICE OF VIOLATION M-89-015 <br />T0: Castle Concrete Company and all other persons engaged in or owning or <br />controlling the following operation: Snyder Quarry, Section 32, Tovmship 13S, <br />Range 67W, of the 6th Prime Meridian, E1 Paso County, Colorado <br />BOARD ORDER <br />Based upon the Findings of Fact stated in the Colorado Mined Land <br />Reclamation Board Order of September 21, 1989, and in accordance with <br />C.R.S. 34-32-124, the Board hereby makes the following modifications to <br />the corrective actions outlined in that order, deleting paragraphs 5a, <br />5b, 6, and 7, and substituting the following: <br />a. Castle Concrete Company is ordered to reclaim the damage to the <br />slope just west of the Phase I area by reseeding the area and <br />replacing damaged or lost trees. Reseeding shall be accomplished <br />by November 1, 1990. Trees shall be planted by June 1, 1990, and <br />shall be established to the pre-existing density. Tree <br />establishment success will be veniEfied by the Division no sooner <br />than the summer of the fifth growing season. Castle Concrete shall <br />include a discussion of their progress in the annual repcrt, <br />including information and data pertaining to the success of <br />planting. <br />Castle Concrete Company is ordered to reclaim the damage due to <br />material slides along the access road shoulder by stabilizing the <br />slides and erosion, reseeding the affected areas, and replacing <br />damaged trees. Reseeding shall be accomplished by November 1, . <br />1990. Trees shall be planted by June 1, 1990, and shall be <br />established to the density of the adjacent undisturbed slopes. <br />Tree establishment success will be verified by the Division no <br />sooner than the sunnier of the fifth growing season. Castle <br />Concrete shall include discussion of their progress in the annual <br />report, including information and data pertaining to the success of <br />planting. <br />The corrective actions are to be undertaken along the pertinent <br />guidelines specified in the Castle Concrete Company Slope Stability <br />Report of July, 1988,•the Castle Concrete Company Corrective Action <br />Plan of July 11, 1989, the Castle Concrete Company Corrective <br />
