This includes the construction of a <br />silt retention facility for sediment control, and the use of a silt <br />fence below the Area 1 slide as outlined on page 6 of the November <br />27, 1989 adequacy response. <br />d. The review and approval of the silt retention facility design plans <br />will be handled by the Division as a Technical Revision ~:o the <br />permit. The plans will be submitted by the operator 60 nays prior <br />to construction. All parties to the Corrective Action Pan Hearing <br />will be notified by the Division as to the submittal of i:he plans. <br />e. The operator will work with the Cedar Heights Lenders an<i the <br />Corrective Action plan objectors on the problems regarding <br />incompatibility of hydrologic controls (culverts) on their <br />respective properties. The operator will submit a final plan to <br />the Division for approval by ldarch 31, 1990. <br />f. The operator is order to submit as-built drawings of the culverts <br />installed beneath the quarry access road. These drawings will be <br />submitted to the Division within 60 days after construction. All <br />parties to the Corrective Action Plan Hearing will be notified by <br />the Division as to the submittal of the as-built drawings.. <br />g. As part of a measure to prevent further rockfall and flyrock from <br />the western edge of the Snyder Quarry, the operator will take <br />measures as necessary to insure that no offsite impacts clue to <br />rockfall or flyrock occurs If, upon Division inspecticm, a <br />situation is created for the potential of rockfall or flyrock, the <br />situation will be brought to the attention of the company, and <br />appropriate preventative measures will be undertaken. <br />2. Based upon these same Findings of Fact and Notice of Violation, and in <br />accordance with C.R.S. 34-32-124, the Colorado Mined Land Reclamation <br />Board 'Hereby modifies the boundary of Permit M-77-210 to include all <br />areas of off-site disturbances. The Board orders Castle Concrete Company <br />to submit a Financial Warranty in the amount of $40,000.00, which must be <br />submitted to the Division on or before February 12, 1990, to cover the <br />cost of reclamation. <br />3. Based upon these same Findings of Fact and Notice of Violation, and in <br />accordance with C.R.S. 34-32-124, the Colorado (dined Land Reclamation <br />Board hereby orders Castle Concrete Company to pay the Colorado Mined <br />Land Reclamation Board a civil penalty in the amount of $1,000.00, within <br />30 days of the signature date of this document. This is based upon an <br />assessment of $150.00 per day for 21 days of violation, from July 6, 1989 <br />to July 26, 1989, with $2,150.00 suspended upon approval by the Board of <br />the Corrective Action Plans referenced in this order. <br />
