Step 7: Submit clans for abatement of anv potential lone-term impacts (cleanine of fines from <br />Foidel Creek, etc.l, including the planned comaletion date. Include directions, concurrence, or <br />• approval from CDPHE. CDOW. and USACE necessary to address anv potential impacts to <br />water quality and aquatic life in Foidel Creek and Trout Creek, and the stream buffer zones <br />10/f 10/06) <br />Clean-up plans were submitted to the CDRMS on 09/14/06 as MR06-211 (copy attached for <br />reference). The CDRMS subsequently notified TCC that concurrence from CDPHE, CDOW, and <br />USACE would be required. To meet this requirement, a copy of the clean-up plans was submitted <br />to these agencies by a-mail on 09/19/06, with a request for their comments and/or concurrence. <br />Documentation of concurrence was received from CDPHE on 09/27/06, from USACE on <br />10/05/06, and from CDOW on 10/06/06. Effective clean-up was weather-dependent, given practical <br />access constraints to the stream azea and the desire to avoid additional disturbance. <br />Clean-up progressed in short segments along the affected stream channel, and involved establishment <br />of temporary barriers in the stream at natural ponding points using straw bales sealed with sand-bags to <br />create temporary catch-basins, washdown of accumulated coal fines from the channel and banks using <br />low-pressure hoses to these temporary catch-basins, removal of the coal fines from the temporary <br />catch-basins using avacuum-truck, and subsequent removal of the temporary flow barriers. Clean-up <br />was targeted ASAP, and all clean-up related activities were completed by the abatement date of <br />10/30/06 for Step 8. Abated 10/06/06. <br />Step 8: Continue ap approved surface water quality monitoring as required by CDPHE: <br />aroviding to CDRMS a copv of the September 2006 DMR for Permit 0027154 (10/30/061 <br />The September 2006 DMR was submitted on 10/27/06, and the CDRMS was copied on the <br />• referenced DMR. Abated 10/30/06. <br />Step 9: <br />Step 9a: Reestablish and document temporary stormwater storage and discharge caaabilities <br />consistent with the approved desiffi (11/17/061 <br />Under a field authorization, TCC proceeded with, and completed modifications (an internal <br />berm creating two separate cells) within the Pond E impoundment area to isolate the coal <br />fines within the pond and reestablish the design storage capacity ASAP. An "as-built' <br />drawing with stage-storage information was provided to the CDRMS on November 17, 2006, <br />documenting reestablishment of sediment and stormwater storage capacities and discharge <br />capabilities consistent with the approved designs in Exhibit 8E. Abated 11/17/06. <br />Step 9b: Remove coal fines accumulation from north aond area and dispose of coal fines in <br />existing coal refuse disposal area (01/31/071 <br />Due to their consistency and concerns about shifting the problem from Pond E to another location,. <br />clean-up of the saturated coal fines was deferred until weather conditions resulted in consistent <br />freezing temperatures. The frozen coal fines were removed in layers, exposing the underlying <br />saturated coal fines, which would then freeze and could be removed. The frozen coal fines were <br />transported to a sepazate area of the existing coal refuse pile where they can gradually melt, <br />allowing the entrained water to drain-off. The drained fines will then be placed, integrated into <br />progressive lifts, and compacted on the refuse pile, consistent with approved design and <br />• construction methods.
