"" , .~~. <br />~~°~~i <br />:~:.~- <br />SUDJ°C4 I 0 o02fu Y••uy,v.r~~ <br />permit and copies of other correspondence and Division phone logs, <br />regarding this matter. <br />Staff noted that Colina Oro Molino, Inc. is also known as COM, Inc. <br />Staff listed the 4 possible violations for the Board to consider as <br />foiiows: i) failure to process ore in the mill which comes from Gcld <br />Hill Ventures' (Gold Hill) properties only, as stated in the permit, 2) <br />failure to use the permitted water-pumping and utilization scheme for <br />mill operations as described in the permit, 3) failure to repair rips <br />in the tailings pond liner using the method approved in the permit and <br />to prevent additional punctures to the liner and 4) failure to contain <br />tailings in the tailings impoundment. Staff said the possible <br />violations would be discussed and considered singuiariy. <br />At this point, Board Member Danielson stated that he serves on a Board <br />of Directors with Mr. Freirich whom he did not realize was a <br />Complainant in this matter. He said he did not feel this nor past <br />contact with some of the other parties would influence his judgment in <br />this matter. There was no objection to Member Danielson hearing this <br />matter. <br />As an introduction to this matter, Staff said the co-operators do not <br />have a working relationship, and this has caused the Division <br />difficulty in obtaining consistent responses, as well as plans for <br />rectifying problems, regarding this site. <br />Staff referenced Exhibit A and discussed the synopsis of events leading <br />to the notices of possible violations. A 2.61-acre 110(2) permit was <br />issued on September 7, 1983 to Gold Hill Mining Company. On June 30, <br />1985, the operator filed an amendment to expand the permit area to 7.63 <br />acres and it was approved on September 25, 1985. That amendment added <br />3 mine dumps, as well as a gravity and flotation concentration mill. <br />The amendment required the operator to process ore from Gold Hill <br />properties only. Staff referenced a map, EXHIBIT B, and described the <br />site; the Cash Mine has been inactive for 3 to 4 years. <br />Staff said the Division approved a request for Succession of Operators <br />on October 2, 1985, from Gold Hi11 Mininq Company to Gold Hill Ventures <br />Limited Partnership. On October 18, 1991 the Division approved a <br />Succession of Operator from Gold Hill Ventures Limited Partnership to <br />Gold Hill Ventures Limited Partnership and Colina Oro Molino, Inc. <br />(COM, Inc.). On October 25, 1991 the Division received Mr. Freirich's <br />complaint, on behalf of the residents of Summerville, that unpermitted <br />water was being discharged from the site. <br />Staff said that on November 18, 1991 Mr. Wayne Tatman, with COM, Inc., <br />indicated a desire to separate the mine from the mill and to process <br />material from various other sources. The Division inspected the site <br />on November 26, 1991 and found 4 possible problems and 2 possible <br />violations, including the violation for processing ore from properties <br />other than Gold Hill properties. <br />On December 9, 1991 the Division received a copy of an invoice which <br />indicated that Mr, Tatman had purchased 400 tons of ore from the Cress <br />
