Staff said <br />that the Division's request, in that instance, would be that the site <br />be stabilized prior to implementing a land use exempting reseeding. <br />It was MOVED that the Board find the operator in violation for mining <br />outside the permit boundary, require the operator to submit a li0(2> <br />permit by April 22, 1992, and direct the Division to work with the <br />operator to establish the final land usa, as discussed, and waive the <br />civil penalty. SECONDED. <br />The Board held further discussion of the issue of the civil penalty. <br />It was MOVED that the Board amend the Motion and change the civil <br />penalty from complete removal, as proposed, and assess a 51,425 civil <br />penalty, with all but 5100 being suspended, based on completion of the <br />corrective action.
