The three violations have been terminated as of this inspection. <br />Violation Lrl cited a topsoil problem. Topsoil in queseion has been <br />pulled back from the highwall and picked up for placement in a top- <br />soil stockpile. I pointed out to Jim and Jeff the need to pro- <br />tect the topsoil stockpiles near the substation on the highwall from <br />contamination during snow clearing and other vehicular activities. <br />P.4i7 <br />Violation fl2 called for a seructure to intercept surface runoff prior <br />to reaching Middle Creek. A small catch basin and diversion berms <br />along the haulroad have been constructed. A question has been raised <br />as to the proximity of the Creek and the required 100 foot undisturbed <br />buffer zone. The nature and size of the violation suggest the location <br />of Che basin Co he the most efficient solution. Tht encroachment into <br />the buffer zone at the site of the catch basin is minimal. This al- <br />lowance, however, does not preclude the operator from any responsibilities <br />for possible effects on the Creek from the disturbance.
