APR~11 '98 lc:al CYPRUS YAMPR VRLLEY 1 p,si7 <br />,~f i <br />15'.12 Sifins and Markers <br />The necessary mina and permit identification and blasting signs were <br />present at the mine entrance from the county road. <br />715.14 Backfilling and Gradinfi <br />The mining operation utilizes a shovel in conjunction with rock trucks <br />for overburden removal. Although no final grading has been accomplished <br />on the area, spoil is constantly being deposited by the trucks in the <br />7~ previous cuts. <br />715.15 llisposal of Spoil and Waste Materials in Areas Other Than the Mine <br />Workings or Excavation <br />A temporary spoil storage pile is located near the highwall where the <br />underground operation has begun and a permanent spoil storage area is <br />south of the coal extraction areas. Both are approved in the <br />Permit 1176-16 mine plan. <br />715.16 topsoil Handling <br />Topsoil had been removed from the entire permit area by scrapers. Most <br />of it had been stockpiled suitably with two exceptions. Violation No. 1 <br />of Notice of Violation Number 79-5-18-6 was issued for failure to protect <br />topsoil from erosion and contamination as approved by the regulatory <br />authority. Specifically, stockpiled topsoil immediately adjacent to the <br />highwall in Section 13, had stress cracks in it and appeared in danger <br />of falling off the highwall into the active coal pit. Also, topsoil <br />had been located in small unprotected piles adjacent to the haulroad <br />leading to the permanen[ spoil sCOrage area. Inspector Gregg required <br />Che company to move all unprotected topsoil to approved topsoil storage <br />areas and to protect the stockpiles from wind and water erosion. <br />715.17 ProtecCion of the Hydrologic System <br />Violation No• 2 of NOV Number 79-5-1$-6 was written for failure to pass <br />all surface drainage from the disturbed areas through a sediment pond <br />before leaving the permiC area. Surface water drainage from the under- <br />ground mine conveyor construction area and mine haulroad was passing <br />thcough a breach in the berm on the haulroad and passing directly into <br />Middle Creek. Unchecked runoff was also entering the creek near the <br />old shovel on the haulroad. Rick Brown was instructed to correct the <br />situation by passing the surface water runoff ehrough a sediment basin <br />before leaving the permic. <br />Generally speaking, the sediment ponds for Mine !13 were noc impressive <br />from ehe design standpoint. No violations were cited since OSM has <br />been enjoined from enforcing sediment pond design criteria. Rick Brown <br />was aware of the problem and Energy Fuels has contracted a consultant <br />engineering firm to work on the ponds. <br />-2- <br />
