SDBE-7. The Program Review Committee may request that the Good Faith
Effort Questionnaire be completed and submitted (with supporting
documentation) by other Bidders to assist in determining if the apparent
low Bidder made a good faith effort.
The determination of the adequacy of a Bidder's good faith effort will be
made by the Committee and will be based upon the following items:
1. The apparent low Bidder's utilization of SDBES compared with other
Bidders;
2. The apparent low Bidder's efforts to contact and interest SDBES,
including:
A. Advertising in:
1) Trade association publications (Daily Journal); and
2) Publications (E1 Semanario, The Weekly Issue and Rocky
Mountain News);
B. Mailings;
C. Contacts with SDBE Contractor Organizations.
D. Phone contacts with SDBES;
E. Assistance sought from the Engineering SDBE Contact;
3. List items of work identified by the Bidder for subcontract, supply
or joint ventures to meet the Program goals;
_ 4. Efforts to negotiate with SDBES to obtain them as subcontractors,
suppliers or members of joint ventures;
5. Efforts to provide SDBES a full and fair opportunity to bid,
including the opportunity to review drawings and to have the time
to prepare bids and negotiate; and
6. The reasons why the Bidder was unsuccessful in its efforts to
obtain SDBES as subcontractors, suppliers or joint venture
partners.
The Committee, in making its determination of the apparent low Bidder's good
faith effort, may require that the apparent low Bidder attend a hearing(s) to
support its good faith effort.
If the Committee determines that a bidder failed to make a good faith effort,
the bid will be deemed nonresponsive and a recommendation to reject the bid
shall be made to the OWNER.
SDBE Program Documents
In order to comply with this Program, Bidders must complete, sign and submit
with their bid a form entitled Statement of Intent to Use Small or
Disadvantaged Business Eaterpriaes (SDBES) (page BF-6). In addition, if the
SDBE goal has not been met, the apparent low Bidder will be required to
