SDBE utilization Mechanisms <br />Bidders may utilize SDBES in several different business relationships, <br />including but not limited to, joint ventures, negotiated subcontracts, or <br />competitively bid subcontracts. Bidders ara encouraged to identify as many <br />aspects of the work as possible to enhance the utilization of SDBES. <br />Bidders are expected to use qualified SDBES. To be qualified, SDBES must <br />have the necessary financial capabilities, skill, experience, and access to <br />the necessary staff, facilities and equipment to perform the work or to <br />provide the supplies or services that are required. In addition, SDBES <br />must be certified as Small or Disadvantaged Businesses by City and County <br />of Denver, the State of Colorado or the Federal Government Programs. <br />Flexibility Relative to Bonding Required <br />Bidders are encouraged to assist SDBES in their effort to obtain bonding, <br />or to include SDBES in any overall bond provided by the CONTRACTOR. Bidders <br />may use SDBES which cannot provide bonding. Rejection of an SDBE due to its <br />inability to provide bonding shall be considered detrimental in the <br />evaluation of the Bidder's "good faith effort" to meet the goals for SDBE <br />utilization. <br />Eaaineerinc SD88 Contact <br />The OWNER has designated an Engineering SDBE Contact who will administer <br />the OWNER'S Engineering Division SDBE Program. At all phases of the <br />bidding process and subsequent execution of the work pursuant to the <br />Contract, CONTRACTORS, subcontractors, and suppliers shall cooperate fully <br />with the Engineering SDBE Contact. It shall be the duty of all Bidders, <br />and the CONTRACTOR awarded the Contract, in cooperation with the <br />- Engineering SDBE Contact, to ensure that SDBES have an equal opportunity to <br />compete as CONTRACTORe, subcontractors or suppliers. Bidders are <br />encouraged to establish a direct relationship with the Engineering SDBE <br />Contact, who will respond to all questions relative to the SDBE Program. <br />The Engineering SDBE Contact will keep a current list of SDBES that are <br />certified by the City and County of Denver, the State of Colorado or any <br />agency of the federal government. All Bidders should understand, however, <br />that all certified SDBES may not be listed, and some listed SDBES may no <br />longer be certified. In providing a list of SDBES, the OWNER assumes no <br />responsibility for the data or the financial or other capabilities or <br />experience of any entity set forth in the list. Further, in providing <br />assistance to Bidders, no warranty is made by the Engineering SDBE Contact <br />or the OWNER that any particular SDBE is qualified to perform the work or <br />to provide the supplies or services that are required or that any such <br />entity will perform as required. <br />Good Faith Effort <br />If the goal specified herein has not been met, it shall be the <br />responsibility of the apparent low Bidder to demonstrate its good faith <br />effort in attempting to meet the goal. The apparent low Bidder, if it has <br />not met the specified goal, must provide a completed Good Faith Effort <br />Questionnaire (with supporting documentation) within 7 days of the bid <br />opening date in support of its good faith effort to meet the goal.
