NONDISCRIMINATION IN CONTRACTING PROGRAM OF THE DENVER BOARD OF WATER COMMISSIONERS Introduction The Nondiscrimination in Contracting Program, a gender and race-neutral policy, provides opportunities for Small or Disadvantaged Business Enterprises ("SDBE"), by ensuring such businesses obtain a fair portion of the Board's construction, purchasing and professional service contracts. The Board has established an SDBE Committee to administer and implement the Board's Nondiscrimination in Contracting Program. Board construction contracts may be subject to SDBE participation goals established by the appropriate Division Director. Goals are based on the size of the contract, availability of certified SDBE's, previous levels of SDBE participation in similar Board contracts, and other appropriate factors. Parties seeking contracts must either meet these goals or demonstrate a good faith effort to do so. The SDBE Committee will conduct a hearing to determine if the potential contractor or supplier has made a good faith effort to obtain SDBE participation. SDBE's shall include any business enterprise that has been certified, in compliance with applicable law, as a Small Business Enterprise ("SBE"), Disadvantaged Business Enterprise ("DBE"), Socially and Economically Disadvantaged Business ("SED"), Emerging Small Business ("ESB"), or a comparable certification, by the City and County of Denver, the State of Colorado or the U.S. Small Business Administration, or other governmental entity. - The SDBE Committee has adopted procedures necessary to implement the SDBE participation program. The SDBE Committee will respond to formal complaints regarding the program, handle appeals of adverse decisions, and make determinations of good-faith efforts.
