complete the Good Faith Effort Questionnaire (pages SDBE-6 to SDBE-7) within 7 <br />days of the bid opening as provided for herein under "Good Faith Effort." The <br />apparent low Bidder will be required to convert its Statement of Intent to <br />individual Letters of Intent (page SDBE-5) within 5 days subsequent to the bid <br />opening. The Letters of Intent shall be substantially the same as the <br />Statement of Intent. Any material changes between the two must be approved by <br />the Board. <br />Additionally, on the final day of March, June, September and December following <br />issuance of the "Notice to Proceed", the CONTRACTOR will be required to <br />complete and submit a fourth form: QUARTERLY SDBE PROGRAM PARTICIPATION REPORT <br />in the format set forth on page SDBE-S so that the OWNER can trace the actual <br />utilization of, and payments to, SDBES. The CONTRACTOR shall also submit a <br />completed FINAL SDBE PROGRAM PARTICIPATION REPORT with the Final Partial <br />Payment Estimate. Material failure to utilize SDBES to the extent listed on <br />the Statement of Intent may be cause to disqualify the CONTRACTOR for future <br />Denver Water projects. <br />Replacement of SDBH <br />It is anticipated that subcontractors and suppliers specified in a Bidder's <br />Statement of Intent will be utilized by the CONTRACTOR. In order for the <br />CONTRACTOR to replace an SDBE listed in its Statement of Intent or designated <br />in a Letter of Intent, the CONTRACTOR must first obtain the approval of the <br />OWNER. In order to gain approval, the reason for the replacement must be <br />explained to the satisfaction of the OWNER. <br />To the extent possible, the dollar amount of work committed to an SDBE firm <br />that is replaced should be placed with another SDBE firm. Zf a portion of the <br />work remains to be done by a replaced SDBE, the CONTRACTOR shall determine the <br />• dollar value of the work to be completed and, to the extent possible, contract <br />that remaining dollar amount with a replacement SDBE firm. <br />SDBE Program Complaints <br />The Engineering SDBE Contact shall receive and attempt to resolve any <br />complaints raised relative to any aspect of the Program. If informal <br />resolution cannot be achieved, complaints shall be brought to the Board's <br />Program Committee.
