We do not believe outside <br />critique of the slurry wall design and construction is necessary. <br />----------------------------------------------------------------- <br />The Prairie Farm - Bruce Rippe <br />Mr. Rippe's home and property is located approximately 7,920 <br />feet southeast of the closest slurry wall and he does not own <br />property within 200 feet of the permit boundary. <br />• Discussed in responses above and addressed in the original <br />permitting process. <br />• Nothing has changed in the permit that would suggest any <br />degradation of the environment due to surface run-on, run-off, <br />discharge and goals and expectations. The Stormwater Manage- <br />ment Plan is still in effect and we have the necessary permits <br />to discharge any water associated with the mining operation. <br />• in the original permit it was determined that there were no <br />jurisdictional wetland on the mine site. Please refer to the <br />letter dated 4/1/2001 from Mr. Timothy T. Carey of the US Army <br />Corps of Engineers. <br />• No changes are needed, the reservoirs are in the same areas <br />covered by the gravel lakes of the same name. No changes were <br />made to the commitment for the wildlife buffer and the wild- <br />life habitat we planned to leave originally is unchanged. <br />• Addressed in item 9 of the staff review. <br />• This is covered in approved Temporary Substitute Supply Plan <br />approved by the Office of the State Engineer for those area <br />outside the proposed reservoir areas. Reservoir areas do not <br />need augmentation plans since there is no impact to the <br />groundwater system if water evaporates from a reservoir. <br />• Gravel mines do not generate chemicals and the by-products are <br />usually fine materials left when the gravel is processed. <br />This all natural material is retained on site and used for <br />reclamation if it can not be sold. <br />• We concur with this assessment. They might even be used to <br />store water for agricultural needs as well. <br />• This has been addressed in pervious correspondence. The town <br />site associated with the monument is located on maps in the <br />Colorado Historical Society Office records. The town bound- <br />ary does not lie within the reservoir areas and was located on <br />the raised ground above the river bottom. We have an agree- <br />ment to protect the site with the Platteville Historical <br />Society and have installed a fence to protect the monument. <br />The monument site is located on the maps and is not 450 feet <br />from the closest slurry wall and 35 feet higher. <br />• Mr. Sharkey and Ms. McCoy are the principal land, oil and gas <br />owners of the property. At no time have the oil & gas produc- <br />ers been denied the right to enter and explore for oil & gas. <br /> <br />
