As noted above Envirocon has provided a detailed explanation <br />of how they plaq to cross the gaslines so they are protected. <br />See the UTILITY PROTECTION AND CROSSINGS guide. In addition, <br />PS&G has an agreement in place that allows them to work within <br />200 feet of the oil & gas facilities. A copy will be supplied <br />as soon as we can get it from our attorney. <br />13. We are not aware of a need to relocate any gas pipelines at <br />this time. The reservoir configuration and sizes are designed <br />around the location of the existing lines. If a gasline needs <br />to be moved it will only be done with the owners approval and <br />cooperation. We would supply a notarized agreement do the <br />Division prior to moving the line. Review of their map shows <br />that they have no gaslines within 200 feet of the reservoir <br />areas. <br />Other Issues -Objector letter responses. <br />Kathryn A. Hardin <br />Ms. Hardin's house is located approximately 4750 feet southeast of <br />the closest slurry wall in the Sharkey's Lake area. We are assuming <br />that the well is in close proximity to the house. Between her <br />house and the reservoir area is the Western Mutual Ditch and area <br />being irrigated as part of the ranching operation. This effec- <br />tively place a water barrier between our mining operation and her <br />well. xo dewatering will take place until the slurry wall is <br />complete and under the current permit we are allowed minor <br />dewatering if an isolation ditch is installed and kept full of <br />water. The slurry wall will be installed between her well and the <br />dewatering area so it will not be affected by the dewatering opera- <br />tions. We believe state law currently protects her and the well <br />from damage if she can show a loss caused by the mining operation. <br />----------------------------------------------------------------- <br />Michael J. Ptasnik - Ptasnik Land Company <br />We do not believe the proposal to convert two of the lakes to <br />developed water storage area and installation of the slurry wall <br />will invalidate the private agreement between Mr. Sharkey and Dr. <br />Ptasnik. The slurry wall will actually eliminate the need to build <br />the recharge structures between the slurry wall the Dr. Ptasniks <br />wells since it will isolate the dewatering area behind an impervi- <br />ous wall. You also might note that Platte Sand & Gravel made no <br />attempt to remove the requirement to install the recharge struc- <br />tures for dry mining in areas outside the reservoirs. In the <br />remaining lake areas, if not lined, the method of mining and well <br />protection precautions will be followed as committed to in 2001. <br />We believe that the Division has adequate staff expertise to review <br />and determine adequacy of the liner design. Platte Sand & Gravel <br />will use Envirocon to build the slurry wall. They specialize in <br />slurry wall installation and will be posting a full cost construc- <br />tion bond for this project. Envirocon has retained Lyman Henn <br />Engineering to prepare the slurry wall design, they are experts in <br />their field and have prepared a number of liner designs for water <br />
