Post-Mining Land Use <br />At present, Permit No. M-1986-104 requires the Montgomery Pit reclamation to be Rangeland. <br />From an historic context Rangeland was at the time of original permit approval and possibly still <br />the most appropriate post-mining land use for this site. AM-1 proposes to change the post- <br />mining land use to Industrial/Commercial. The reason for the change is that B&B desires to <br />move its operational headquarters to this location. Keep in mind while reviewing these <br />comments that the Montgomery Pit is located in close proximity to the Town of Eagle, <br />approximately one (1) mile west. B&B Excavating operations aC this location would be a gravel <br />pit (mining remaining reserves), importing aggregate materials and processing aggregate <br />materials, which includes crushing spreads, asphalt plant and concrete batch plant. Operations <br />also include, but are not limited to, a good size employee base, use, storage and <br />maintenance/repair of many pieces of equipment. An operation of this size and nature would <br />potentially create impacts to traffic on area roads and highways, air quality, water quality, visual <br />quality and possibly even wildlife habitat. At this time, B&B uses the gravel pit minimally so the <br />operation has limited impact. <br />The proposed change that has been applied for by B&B we believe has local land use authority <br />implications that first need to be addressed. The Montgomery Pit is located in unincorporated <br />Eagle County, zoned Resource and the use operates under a special use permit for a gravel pit. <br />The desired use of this site by B&B and the proposed post-mining land use are not in accord with <br />Eagle County Zoning. At minimum a new special use permit for processing is required because <br />the operation is being expanded to include processing of materials for topsoil, road base, asphalt, <br />concrete and other aggregate products. It could also require a PUD or zoning change to facilitate <br />B&B's plans. It is the Town's understanding after discussions with Eagle County and B&B that <br />the application for amendment has been revised. Effectively, said revision requires B&B to gain <br />Eagle County review and approval. This revision is a result of discussions B&B had with Eagle <br />County and the fact they will need land use approvals before they can implement their plan to <br />move their headquarters to this location. However, it is not clear if the required local approvals <br />are to be obtained prior to AM-1 approval or post AM-1 approval. If it is post and approval is not <br />granted by Eagle County, does required reclamation default to Rangeland or would it remain <br />Industrial/Commercial In IighC of this use's potential impacts a decision on this amendment as it <br />relates to the reclamation plan is not appropriate at this time and should not be rendered until <br />such time as local land use approvals are authorized. This is important, as the DIvIG is well <br />aware, because these types of uses (industrial in nature) are not necessarily compatible with other <br />uses. By taking such action the DMG would allow review of location, design, configuration and <br />intensity of use, and the imposition of appropriate conditions to ensure compatibility of the use <br />with; (I) surrounding land uses; (2) zone district standards, (3) impacts, such as traffic, dust, <br />noise; (4) water, air and visual impacts; and (5) consistency with Master Plans. <br />The planned use at this site is also required to be consistent with the Eagle County Master Plan <br />and also the Eagle Area Community Plan. Eagle County's Future Land Use Map identifies this <br />area as Rural. The Eagle County Master Plan recognizes commercial activities within this <br />designation being limited to isolated uses, which are permitted by special review when they are <br />compatible with the character of adjacent uses and meet the criteria of the Land Use Code.
