Certainly, the <br />Community Plan seeks to create a diversified local economy, but this move would locate an <br />industrial type commercial development to our community area where it is not necessarily <br />desired or planned. In addition, the move potentially encourages a future growth scenario of <br />continuous strip development (commercial, light industrial, industrial and airport uses) between <br />the Towns of Eagle and Gypsum, which is contrary to the Community Plan. To be more specific, <br />the unincorporated area between Eagle and Gypsum is planned as a community separator. The <br />local controlling jurisdictions need the opportunity to decide if this will or will not happen. A <br />decision now by the DMG to approve the post-mining land use change would presuppose this <br />sites future land use. <br />The Town of Eagle respectfully requests that the DMG require that B&B acquire all necessary <br />land use approvals from Eagle County prior to approving AM-I. The proposed use has the <br />potential to impact the Town of Eagle in areas such as air quality, water quality, noise and traffic. <br />In addition, there are Master Plan and Community Plan issues that also need to be dealt with by <br />the local jurisdictions prior to a decision being rendered. We believe that the appropriate forum is <br />through Eagle County's Land Use Regulations and Processes. Granting approval of this <br />amendment now is clearly getting "the cart before the horse." It doesn't work. If the DMG <br />chooses to approve AM-1, the approval must stipulate too that if land use approvals are not <br />obtained than reclamation shall be Rangeland retroactively. The Town of Eagle does agree with <br />the amendment as it relates to the overall reduction to the mining area boundary. <br />Thank you for the opportunity to participate in the amendment process with the Division of <br />Minerals and Geology.
