As for Technical Revision (TR) No. 7, the Environmental Protection <br />Agency revision to their rules to allow prep plant discharge renders an <br />emergency spillway for Pond 006 acceptable. The design for Pond 006 recently <br />included in Exhibit 19 of the permit application, however, shows the spillway <br />elevation at 7,388 feet or 2.2 acre-feet capacity. The thickener volume is <br />stated to be 704,973 gallons or 2.16 acre-feet. With the spillway at this <br />level, one foot of freeboard is not maintained. An acceptable design must <br />incorporate one foot of freeboard above the 2,16 acre-feet level and one foot <br />below the base of the emergency spillway. Exhibit 19 also does not contain <br />size requirements for or dimensions for the emergency spillway. A copy of the <br />NPDES Permit allowing discharge of prep plant water from the pond is also <br />required. <br />As for TR 10, the sewage facility design is acceptable. A copy of the NPDES <br />Permit allowing discharge of sewage water from Pond 006 is required. It is <br />strongly recommended that in the event sewage water is discharged to Pond 006, <br />Wyoming Fuel Company commit to not recirculating water from the pond into the <br />prep plant until it meets effluent limits applicable to sewage discharge. <br />Sincerely, <br />'~~/ ~~_ <br />James C.
