• FJOK1200 f�Gc 7 <br /> at any point higher than the existing elevation . <br /> 6 . There is presently a fence running generally <br /> East and West through the leased premises , and the farm land <br /> referred to above lies North thereof . When Corn needs additional <br /> room for its gravel operation it shall move the fence Northward <br /> to the North boundary of the property that Corn then needs . <br /> The fence will be installed at the new point in a workmanlike <br /> manner , and the movement of the fence will be at the sole expense <br /> - of Corn. <br /> 7. Corn shall have the right to install machinery, <br /> equipment, personal property, telephone lines , electric lines <br /> and water lines in and on the leased premises and shall have <br /> the right to remove such property from the premises at the <br /> end of the lease term. <br /> 8 . Corn shall hold Woodrings harmless from all taxes <br /> which may be assessed or levied against the property installed <br /> by Corn or against any stockpiled materials on the leased premises. <br /> In addition thereto, if the ad valorem real property taxes <br /> shall be increased solely by virtue of the mining activities <br /> of Corn the amount of such increase shall be paid by Corn to <br /> Woodrings during the term hereof . All such payments shall <br /> be made before the respective taxes become delinquent. <br /> 9 . As consideration for this Lease Agreement, and <br /> each and every covenant of Woodrings herein contained, Corn <br /> agrees to make payment to Woodrings as follows : <br /> A. A royalty of 20¢ per ton for each ton <br /> of gravel removed from the leased premises. <br /> B. Annually , on the anniversary date of <br /> the effective date of the lease term, the <br /> royalty of 20j� per ton shall increase or <br /> decrease exactly in proportion to the increase <br /> or decrease in the Consumer Price Index <br /> for Urban Wage Earners and Clerical Workers , <br /> "All Items" category, as prepared and published <br /> by the Department of Labor , United States <br /> of America. Such increase or decrease <br /> shall relate to the index published for <br /> the month in which the lease term becomes <br /> effective as compared to the most current <br /> -4- <br />
