WHEREAS, the said property contains gravel , and
the parties desire to lease the premises so that Corn may
extract gravel therefrom under the terms and conditions herein
contained;
NOW, THEREFORE , it is aareed :
1 . Woodrings hereby grant unto Corn the exclusive
right to enter upon the real property above described and
to extract, process , stockpile and remove gravel therefrom
in accordance with the terms hereof .
2 . The said property is presently under lease to
the County of Mesa, State of Colorado , which expires April
1, 1980 , and the County of Mesa is operating a gravel pit
thereon pursuant to a permit from the Colorado Mined Land
Reclamation Board. Corn agrees that notwithstanding the present
position of the County of Mesa , State of Colorado, Corn will
proceed to make necessary applications to Mesa County, Colorado,
for a permit to extract gravel from the leased premises and
to the Colorado Mined Land Reclamation Board for the issuance
of a gravel permit relating thereto. If either of such permits
are denied then this Lease Agreement shall terminate and be
of no further force and effect. The effective date of the
lease term shall commence on the date of the last such permit
to issue or on April 1 , 1980 , or on date of any mutually-agreed
termination of the present lease with the County of Mesa , State
of Colorado, whichever shall be the last date to occur. The
lease shall extend for a period of ten (10) years thereafter.
3 . Corn shall have the privilege of access to the
leased premises prior to the effective date of the lease term
for the purpose of performing any preliminary work necessary
to perfect the application for permits referred to above;
provided, however , Corn shall not interfere in any fashion
with the right of possession of the County of Mesa pursuant
to its lease agreement. The parties acknowledge that some
