BOOY 200 FAA27 <br /> WHEREAS, the said property contains gravel , and <br /> the parties desire to lease the premises so that Corn may <br /> extract gravel therefrom under the terms and conditions herein <br /> contained; <br /> NOW, THEREFORE , it is aareed : <br /> 1 . Woodrings hereby grant unto Corn the exclusive <br /> right to enter upon the real property above described and <br /> to extract, process , stockpile and remove gravel therefrom <br /> in accordance with the terms hereof . <br /> 2 . The said property is presently under lease to <br /> the County of Mesa, State of Colorado , which expires April <br /> 1, 1980 , and the County of Mesa is operating a gravel pit <br /> thereon pursuant to a permit from the Colorado Mined Land <br /> Reclamation Board. Corn agrees that notwithstanding the present <br /> position of the County of Mesa , State of Colorado, Corn will <br /> proceed to make necessary applications to Mesa County, Colorado, <br /> for a permit to extract gravel from the leased premises and <br /> to the Colorado Mined Land Reclamation Board for the issuance <br /> of a gravel permit relating thereto. If either of such permits <br /> are denied then this Lease Agreement shall terminate and be <br /> of no further force and effect. The effective date of the <br /> lease term shall commence on the date of the last such permit <br /> to issue or on April 1 , 1980 , or on date of any mutually-agreed <br /> termination of the present lease with the County of Mesa , State <br /> of Colorado, whichever shall be the last date to occur. The <br /> lease shall extend for a period of ten (10) years thereafter. <br /> 3 . Corn shall have the privilege of access to the <br /> leased premises prior to the effective date of the lease term <br /> for the purpose of performing any preliminary work necessary <br /> to perfect the application for permits referred to above; <br /> provided, however , Corn shall not interfere in any fashion <br /> with the right of possession of the County of Mesa pursuant <br /> to its lease agreement.
