monthly index available on the anniversary <br /> date in each year of the lease term. <br /> Such increase or decrease , when so determined , <br /> shall control until the next anniversary <br /> date of the effective date of the lease <br /> term. <br /> C. All gravel shall be weighed before <br /> it is removed from the premises on scales <br /> to be provided by Corn. The royalty shall <br /> be paid to Woodrings by the 25th day of <br /> each month for materials removed in the <br /> preceding month together with a written <br /> statement as to the computation thereof, <br /> and weight tickets shall be available for <br /> examination by Woodrings at all reasonable <br /> times . <br /> 10. It is contemplated between the parties that <br /> Corn shall enter into an agreement with Mesa County, Colorado, <br /> which will permit Mesa County to enter upon the leased premises <br /> and mine, crush, stockpile and remove gravel . The agreement <br /> with Mesa County shall provide that Mesa County will use the <br /> scales of Corn and will weigh all gravel before it is removed <br /> from the premises . The weighing of such gravel shall be performed <br /> by employees of the County and copies of weight tickets given <br /> i <br /> by Mesa County to Corn. Corn shall pay royalty at the rate <br /> set forth hereinabove to Woodrings based upon such weight <br /> tickets. <br /> 11 . Corn shall conduct its business on the leased <br /> premises in accordance with each and every requirement of <br /> the Colorado Mined Land Reclamation Board, including, but <br /> not by way of limitation, all obligations for reclamation <br /> of the property whether imposed by condition contained within <br /> the permit, statute or regulation. <br /> 12 . Voodrings warrant the title to the leased premises . <br /> 13 . Prompt payment of the amounts herein agreed <br /> upon to be paid by Corn and compliance with all terms and <br /> conditions herein expressed is of the essence of this Agreement, <br /> and if Corn shall fail to make said payment or payments or <br /> shall fail to keep and perform the covenants herein contained, <br /> Woodrings may give Corn written notice of their intention <br /> -5- <br />
