Section III - Status of Stipulations <br /> (continued) <br /> Stipulation No. 19 <br /> Colorado Westmoreland, Inc. is directed to complete Phase III of the <br /> stability analysis and redesign of the final reclaimed configuration of <br /> the surface facilities of the Orchard Valley Mine, as described in the <br /> various letters of proposal from Merrick & Company and Geohydro <br /> Consultants included in Volume 10 of the amended application. The scope <br /> of Phase III shall include the utilization of the findings and <br /> recommendations of Phase II to complete final design of the proposed coal <br /> processing waste pile at the Orchard Valley Mine. This project shall <br /> proceed in a timely fashion to completion by June 30, 1982. The Division <br /> shall be kept informed by monthly letter of the progress of this task by <br /> the operator. Upon finalization of the coal processing waste pile design, <br /> the Orchard Valley Mine plan shall be appropriately amended. <br /> Resolved: The Phase III stability analyses of the waste rock pile may be <br /> found in Volume 6A of the permit application and were completed between <br /> 1982 and 1984. <br /> Stipulation No. 20 <br /> The applicant must, within one year of the permit issuing, submit a plan <br /> to the Division for restoring the essential hydrologic functions of the <br /> Stevens Gulch and north fork of the Gunnison alluvial valley floors . This <br /> plan shall identify the essential hydrologic functions of these two <br /> alluvial valley floors and must show in adequate detail how the essential <br /> hydrologic functions will be restored . <br /> Resolved: CWI submitted a plan to restore the essential hydrologic <br /> function of AVFs on August 8, 1982 and September 7, 1982 . This was <br /> approved by the Division on December 10, 1982. <br /> Stipulation No. 21 <br /> The operator shall submit to the Division an annual report of inflows , <br /> discharges, and consumption of water within the mine. This report is to <br /> include a mine workings map showing the location and quantity of inflows ; <br /> a table keyed to the mine map which shall contain the source <br /> ( i .e. fault, fractures , etc. ) , quantity, duration and quality (i .e. pH, <br /> electro-conductivity and temperature) of all measurable inflows ; a table <br /> containing records of water imported for use within the mine; a discussion <br /> of the water balance within the mine; and finally, a projection of <br /> hydrologic impacts of mining in the upcoming year. <br /> Resolved: This stipulation is currently found as Stipulation No. 29 in <br /> the 1988 document. <br /> _11 _ <br />
