Section III - Status of Stipulations <br /> (continued) <br /> Stipulation No. 16 <br /> Colorado Westmoreland, Inc . is directed to finalize the design of the <br /> proposed coal processing waste structure at the Orchard Valley Mine. <br /> This design is to be completed by June 30, 1982. Prior to appropriate <br /> amendment of the mine plan, the operator may continue placement of coal <br /> processing waste at the existing waste pile location. However, waste <br /> placement must conform with the requirements of Rule 4. 10.4(3) , and the <br /> total amount of coal processing waste placed in the existing site shall <br /> not exceed 25,000 yards, including waste now deposited at that site . In <br /> the event that the total quantity of waste disposed of at the existing <br /> site exceeds 20,000 yard3, the operator shall inform the Division <br /> immediately. If total waste placement is anticipated to exceed <br /> 25,000 yard3 at the existing site, the operator shall complete a <br /> stability analysis of the existing coal processing regulations of <br /> Rule 4. 10. If the total quantity of coal processing waste exceeds <br /> 25,000 yard3 at the existing disposal site , that structure shall be <br /> brought into conformance with the performance standards of Rule 4. 10 <br /> within six months thereafter. Furthermore, in addition to the inspection <br /> and reporting or calculations to verify the total accumulated quantity of <br /> coal processing waste disposed of at the existing site as a portion of its <br /> quarterly inspection report to be submitted to the Division. <br /> Resolved: Waste structure design submittals were received by the Division <br /> in 1982, 1983 and 1984. They are currently incorporated into the permit <br /> application in Volume 6A. <br /> Stipulation No. 17 <br /> Colorado Westmoreland, Inc. must submit to the Division a complete topsoil <br /> salvage plan for the proposed six-acre expansion of the waste disposal <br /> area within one month after the location of this file has been determined, <br /> and prior to any disturbance to the area. This plan must include <br /> site-specific soil profile descriptions , sampling of soil horizons in <br /> sufficient detail to determine salvage depths, soils analysis for <br /> representative samples of each major soil horizon for each soil type for <br /> the soil testing parameters listed in Appendix B, a Soils Suitability <br /> Table, and a table showing stripping depths and salvage volumes . This <br /> plan need only consider those portions of the six-acre area which will be <br /> disturbed during the term of the permit. <br /> Resolved: A topsoil handling plan for the waste structure was reviewed <br /> June 15, 1983 by the Division. Topsoil handling at the waste pile and <br /> throughout the site is described in Section 2.05.3(5) in the permit <br /> application. <br /> Stipulation No. 18 <br /> Following stockpiling, topsoil stockpiles that will not be redistributed <br /> for five or more years shall be seeded with the proposed permanent seed <br /> mix (excluding shrubs and trees) and not the temporary seed mix . <br /> Resolved: CWI made a commitment to use the permanent seed mix on long <br /> term topsoil storage piles in Section 2 .05.4(2)(e)(ii ) of the permit <br /> document. <br /> -10- <br />
