Section III - Status of Stipulations <br /> (continued) <br /> Stipulation No. 22 <br /> Colorado Westmoreland, Inc. must submit to the Division an annual <br /> hydrologic report. This report shall include an analysis of all <br /> hydrologic data gathered during the year, an assessment of the impacts of <br /> mining during the year, and an estimate of the projected impacts of mining <br /> in the following year. This report shall assess the impacts of mining on <br /> the quality and quantity of water in surface streams, springs, groundwater <br /> aquifers , mine inflow and mine discharges. <br /> Resolved: CWI submitted its first annual hydrologic report on January 21 , <br /> 1983 and has produced additional reports annually. Currently, CWI commits <br /> to the submittal of an Annual Hydrology Report in 2 .05.6(3)(b)(iii ) by <br /> '✓1feid March 1 of each year. <br /> lo �/)f lloStipulation No. 23 <br /> Colorado Westmoreland, Inc. is directed to complete Phase III of the <br /> stability analysis and redesign of the final reclaimed configuration of <br /> the surface facility area of the Orchard Valley Mine, as described in the <br /> various letters of proposal from Merrick & Company and Geohydro <br /> Consultants included in Volume 10 of the amended application. The scope <br /> of Phase III shall include the utilization of the findings and <br /> recommendations of Phase II to complete specific engineering redesign and <br /> amendment of the final reclaimed configuration of the surface facilities <br /> area of the Orchard Valley Mine. This project shall proceed in a timely <br /> fashion to completion by December 31 , 1982. The Division shall be kept <br /> informed by monthly letter of the progress of this task by the operator. <br /> Upon completion of Phase III , the Reclamation Plan Section of the <br /> Orchard Valley Mine Plan shall be appropriately amended. <br /> Resolved: The surface facilities reclamation plan was submitted in <br /> January 1983. It is found in the current permit application in Volume 6A. <br /> Stipulation No. 24 <br /> Within 30 days after the completion of Phase III of the stability analysis <br /> and redesign of the final reclaimed configuration of the surface facility <br /> area of the Orchard Valley Mine, the applicant must submit to the Division <br /> a revised backfilling and grading cost estimate for the surface facility <br /> area. If this revised cost figure is greater than the present estimate, <br /> the amount of the reclamation bond will be increased accordingly. <br /> Resolved: Bond calculations were received by the Division on July 9, <br /> 1984. The Division responded On August 8, 1984, and the bond was accepted <br /> on November 29, 1984. <br /> -12- <br />
