Richartl D. Lamm
Governor
DEPARTMENT OF NATURAL RESOURCES
Oavitl H. Getche0. Executive Director
MINED LAND RECLAMATION DI\
DAVID C. SN ELTON, Director
March 27, 1985
Mr. Robert Hagan
Office of Surface Mining
Reclamation and Enforcement
219 Central, N.W.
Albuquerque, New Mexico 87102
Re: Ten Day Notice 85-2-244-6 TV-1, New Elk Mine; C-012-81
Dear Mr. Hagan:
The above referenced TDN addresses placement of non-coal waste in an area
adjacent to the powder house-cap house road in the vicinity of the west portal
of the New Elk Mine. The area in question was used extensively as a dump area
by Cf&I, the previous owner of the mine. The permit application designates
this area as a scrap storage area where material of some salvage value is
placed. The final disposition of all items left in this area is disposal at
the local sanitary landfill or other appropriate locations during the
reclamation operation.
At this time, given that this is an historical (pre-law) dump, it is
impossible to determine whether any dumping other than what is approved in the
permit has occurred at the site. If a Division inspector determines in the
future that material which is not salvageable is being disposed at this site,
or if the material is not appropriately hauled away, an enforcement action
will be warranted. No violation exists, therefore, no enforcement action is
required.
If you have any further questions please call me.
Sincerely,
Brian E.
