Despite this fact, the <br />area has been, and is now being, used for the non-permitted <br />disposal of non-coal waste; the present operator is liable. <br />Your offices' excerpt of the approved mine plan that pro- <br />vided backup for your response identifies the area as a site <br />for temporary storage of used machinery, scrap iron and <br />miscellaneous equipment. Items noted on the site during the <br />inspection included construction lumber, discarded shipping <br />crates, office trash, shop containers with oily residues, a <br />refrigerator, tires, empty barrels and other minor indust- <br />rial waste. <br />OSM finds that your response is inappropriate.
