WAYNE SMITH: You haven't heard all the evidence.
DICK WARD: I have Beard the problems that were indicated as far as reclamation plan, etc.
. So, I think you people are in the position to decide which review is the
better route. We can sure vote on it if that is what you desire but I
WAYNF SMITH: You have already told me, and it is on tape that it is your opinion
it would be denied. Now that you have made up your mind which way you
are going to vote, based on the problems with one third of the evidence
coming before you.
SIIERMAN BLACH: We have heard all the evidence.
LARRY BROWN: He is trying to help yuu and give you an indication of the way he is headed.
Because you have to make the decision request a continuance or force us
into action.
WAYNE SMITH: He shouldn't take any action until he has heard all the evidence.
LARRY BROWN: We have heard, and what he was also saying was that he has heard enough.
DICK WARD: Do you have evidence as to the reclamation plan that was not heardY~,V4j~

WAYNE SMITH: [das Mr. Janes through, have you gone through all 13 itQms?.""' ;~~: °y~yu

BRAD JANES: Ive gone through them entirely. 1~ ' ~ .vuJP.,b

LARRY BROWN: Will you request a continuance. '
WAYNE SMITH: I think based on Mr. Ward's statement, yes ~r ~
we cYCrd.
DII:K IJARD: I'm going to be nailed with that, I don't think that it individualizes
me because I think the rest of the Board agrees with me, you may not
accept it, but we are trying to work out the best thing that we think
has come out of this board review, it may not appear to you that way.
WA7rNE SMITH: You gave an indication that me could get a special meeting within a couple
of weeks,
DICK WARD: I didn't promise that because there is no way to know the schedules of all
the Board members. We have indicated to other operators that we would try
WAYNE SMITH: If we were to say get these records all to the satisfaction of the staff
in the meantime would there be a need for a ~Iecial meeting?
Is that possible? In other words, inaudible, if they are resolved to the
satisfaction of the staff is it possible?
DICK WARD: That's what we are saying, that we don't, what I am saying I don't wish to
do. And that is to have that many stipulations. We have provided permits
with a few stipulations but the nature and the quantity of them, personally
to me says no, there is an inadequacy here that requests that this is beyond
the point of one or two stipulations, that it should not be permitted with
staff approval, that the Board should indeed hear more about it and the
staff should hear more before further consideration.
