to respond to the adequacy letter, I think we could have gotten that.
Even three or four more day, time was short and we tried to whip this out.
Worked virtually every day with the staff and we come in to this meeting
feeling that we have dealt in good faith all the way along and that there
really isn't anything that is not really resolved at this point, in

LARRY BROWN:
WAYNE SMITH:
DICK WARD:
WAYNE SMITH:
trying to get this operation going. We have resolved everything with
the Corps of Engineers and they are here to state that, we have resolved
everything for the flooding path, working with the Water Conservancey.
Virtually everything is resolved, we are just (inaudible) not being able
to proceed with this just because of a few minor things. We would like
to have you be comfortable with it, but I think if you went through these
you would be more comfortable with it.
Some of those are pretty significant things, like leave the pond seperators
rather than put in artificial pond seperators, means you don't mine that
gravel. That is fairly significant. Leave some trees. That means you
don't mine the gravel anywhere near those trees, those big cottonwood trees.
We have agreed with that, there is no problem with that. That is the
recommendation of the staff and the county agrees to that.
I think you not quite fair when you say that you didn't get the information
the requirements included the outset, the reclamation plan including seed
mixture. So it should not be that you have to be told that.
I can't really tell you why we don't have that, I thought we had that
information in there. It was pointed out in the adequacy letter that
we received last week. We worked all week on it last week and through

DICK WARD:
WAYNE SMITH:
DICK WARD:
WAYNE SMITH:
DICK WARD
WAYNE SMITH:
DICK WARD:
the week end and got it back down here just as quickly as we could and
I was surprised to find that we didn't have a seed mixture but that is a
fairly standard thing for a particular area. Is SCS going to make the
recommendation and no question we will follow that recommendation.
That to me is a very minor thing and is not worthy of (inaudible)
I think we are at the point, do you want us to vote on this now, or do you
wish to ask for a continuance.
I think the Board has already told us, didn't I hear you say Mr. Ward that
you thought this would be denied.
No, No, I said
Yes you did.
No I did not, I said
You said in your opinion it would be denied as of this moment.
As of this moment, that is right. That is correct.
