feels that they are going to deny it anyway, regardless, I would just as <br />soon vote today, because, rather than put more money Into it. <br />DICK WARD: That is what we would like to have you work on. <br />That's not what is being said at all, the way I understand it. <br />We said that there are inadequacies here that are not before the staff, <br />and the Board should properly be, work on those, get it into the staff ~ <br />and then have a meeting of the Board, if it can be done on the 19th of Novembers <br />with your discussion of the oamership question, great. If not we will <br />try to accomodate a special meeting. When the staff is in a position to <br />make unequivical recommendations with fairly minor stipulations, this <br />is a laundry list, I don't see any of the Board members comfortable with it. <br />I think the option before you is to have it come to a vote and be either <br />voted up or more likely down today; or to request on your part a continuance <br />with that proposition that a special, meeting be called as you get the <br />material into the staff and the things that we talked about are satisifed <br />in their mind and they call us or November 19th preferably. <br />JOHN WARD: We do what we can to avoid actually denying a permit under these kinds <br />of situations. However, because once that action is taken then it requires <br />the applicant to go back and resubmit, republish, the whole bit. This way <br />if we are allowed to have more time so that we can get rid of some of these <br />problems plus the consideration of the objection rather then to be forced <br />into a situation where we don't (inaudible) to act positively, legally <br />we are trying to do something to accomodate you, rather than not trying <br />to stop your operation. But hopefully to make something compatible here <br />with the objections and with the concerns of the staff and also with your <br />timetable. <br />WAYNE SMITH: We wouldn't have even tried to get this on the schedule had we not felt <br />that basically everything had been resolved except for a few minor things. <br />I don't want to delay the issue but I think the things that have been <br />mentioned so far, virtually everything we have agreed to, concurred in, <br />and concluded that they would be done and there hasn't been anything mentioned <br />yet that hasn't already been resolved. Admittedly there are many things <br />on the list, Ralf of them a things that just comments, I don't have a list <br />of the comments, I read them over before lunch, they are just comments <br />statements from the county that we will do the reclamation. That is the <br />matter of, jusC our whole reclamation plan is submitted which is evidence <br />that we will do reclamation. I don't know what else we can provide. <br />Other than submit a reclamation plan and come down here and do a test try <br />on it.
