r <br />There are lots of gravel pits that are in flood plains, and yes indeed <br />we are concerned about adjacent landowners. <br />GARY SLOVAC: The flood plain, inaudible, river is two feet lower than my side. <br />I don't think I am in a possible flood zone because the other side of the <br />river is two feet lower than ours. The St. Vrain has never had a reputation <br />of flooding there. <br />Inaudible, several voices. <br />JOHN WARD: Just a moment, lets conduct this thing in an orderly way. <br />DAVE SHELTON: If you would like a statement on that fine, we've got the flood plain <br />study from the Corps of Engineers, but so what, ... <br />BRAD JANES: The significant thing in my mind, to my knowledge, all of the environmental <br />concerns from both parties have been worked out to an assessible solution. <br />That was the reason for getting this thing kicking into operation, get the <br />bond thing done, to get it out of the way, and on their way and to resolve <br />the situation. I felt that we had worked out a situation that did resolve <br />it, in the form of buffer strips proposed. <br />JOkQI WARD: That may be true, I think, speaking for myself, I'm not sure that it hasn't <br />all been resolved. I'm feeling very uncomforable, with what we have heard <br />here today, and I think this suggestion, lets find out what the County can <br />do about their lease, as it might bear upon their abilities by the November <br />19th meeting, otherwise, if that can't be accomodated. We will gather up <br />four bodies and have a special meeting on this thing and try to take it <br />so you can operate it, if this is a good mine, capable of operation. <br />WAYNE SMITH: I guess I don't understand, are you worried about what type of seed <br />we are going to use for reseeding2 <br />DAVE SHELTON: That is one. <br />DICK WARD: One of several things. It in itself if fairly minor but it is a requirement <br />for a plan, etc. So what we are really asking you, I think, as I understand <br />it, before you is a set of two possibilities. One is if the someone would <br />recommend approval or denial of this, the board would vote. I guess my <br />thought is that there is at least a fair chance that it would be denied <br />today. The other possibility is for you to say I wish for it to be continued <br />with the proposition that a special meeting be called of the Board prior <br />to November 19th if you cannot work out an extension on your lease from <br />the 15th to the 19th. <br />WAYNE SMITH: That isn't really the problem, extending the lease, it is a matter of the <br />option to purchasing.
