aspects of the site solved, get thet out of the way so that both parties
can go about their means of making a living and that the main issues be
resolved to the satisfaction of everyone. This is not a typical situation
it is a special situation, and reserve the right to request that it be
treated in a special manner, and it is, if can be approved with those
stipulations.
DICK WARD: For me, the other side of my parent equation is that if we effect offered
the possibility of special meetings to other operators to close but not
quite that we have some obligation to consider that for this applicant.
So that would be my suggestion, that we agree, that as we did with other
operators to try to hsve a special meeting if this gets completed to the
Boards satisfaction and called down to deal with the question of giving
a permit. In the other cases, something got worked out and we didn't
actually get called for special meetings and so I would hope that the
operator, if this is what he would do, Weld County would try to get from
their lessor their option to go until the 19th of November and when the
but if that can't be done then call a special meeting.
BRAD JAMES: What incentives do we get the county to submit the information in a timely
manner.
LARRY BROWN: I think they have incentive enough.
DICK WARD': I think they have their incentive, they want to get their permit.
r
y; -
DAVEi$H$I.3'ON: Just one comment, it may be a special operation in some ways, but it is
t. ?;i
,` not in other ways. It is a gravel pit along a flood plain. There are
~:
~- _ - probably I~undreds in the state, almost identical to this one. Nothing
- special about it in that regard. What is setting this one apart from
"J
others is 1) it is an illegal operation and got caught and 2) there are
= , ~.; ~.
.` •~ -= ~
~'F;Q~ some very vocal. opponents. That's what sets it apart and that's why it has
+ been different then any of a hundred others that we have seen. OK?
Lets put it in perspective, it is not an unusual environmentally not in the
slightest bit, it doesn't have unusual problems.
GARY SLOVAC: It does another one because it created problems from the adjacent landowners.
It caused quite a bit of damage.
DAVE SHELTON: That is a matter of judgment, thats....
I understand your concern and I know iC has been alleged that flooding
caused damage that wouldn't, if it hadn't been for that operation it
wouldn't have happened. I understand Chat and I also know that preliminary
flood plain studies show that you are well within the flood way of the 100
year flood plain. So, that's neither here nor there.
