LARRY BROWN: OK, Brad I have a question. Surely you have been through all these <br />pictures and the newspaper article and all the reasons, you have heard <br />all the pros and cons. What is your recommendation. Should we find a <br />violation2 Is there evidence of a violation on September 12, or whatever <br />date that is? <br />BRAD JAMES: OK, Weld County says they are in the river, that clearly is not removing <br />stockpile, this could be a violation, there explanation however, you have <br />heard it, that person was requested to create a ramp to create a ramp for i <br />cattle for the landowner, Mr. Baumgardner. To me, we can set up a hearing <br />for it if you would like, I think it is outside of the realm of what ~ <br />we are trying to do here today, and that is address the permit issue. <br />Of course, if that again creates a 120 problem maybe everything should be <br />deferred until we discuss it, but to me the important thing is as a specialist, <br />as a Reclamation Specialist, the important thing is and is like has been said <br />here before, the reason for issuing civil penalties and violations <br />is to get an operator into compliance with the law. We have permits <br />coming in from Weld County, we have one before us today and I feel that <br />it is an important one, and I feel that it is important because there are <br />some major environmental issues involved. And if you want to attach that <br />portion of it I feel the Board is well within its rights to go that way. <br />But I am not prepared to make a recommendation on that now. <br />My personal opinion is that it would be time consuming and you would be <br />kicking a dead dog. <br />DICK WARD: I didn't hear Larry asking if that was the thing that we Qanted to do, <br />he just asked for your opinion. <br />SHERMAN BLACH: What is your recommendation? <br />BRAD JAMES: My recommendation is that. <br />LARRY BROWN: I think I got an answer, I think he said it is probably a violation, I think <br />is what his answer is, is the answer he gaIIe me. <br />BRAD JAMES: It is a violation, I just feel that there are more important issues before <br />us today, and that this issue should probably be deferred, if it is to be <br />discussed, at a either a formal hearing or in another meeting. <br />SHERMAN BLACH: I am a little uneasy with approving a permit today with all of these <br />conditions. If we had one or two that can be resolved, but, some of these <br />aren't of that magnitude, but....... <br />BRAD JAMES: There are a lot of conversations regarding this information, in talking <br />it over with the consultant over what we needed, it just wasn't there, <br />and my effort and intention was to work with the offices, the more problematic <br />
