JOHN WARD: I think a special meeting would be needed, not just because these things <br />are taken care of Co the staff's satisfaction. We have on the record <br />. an objection with civil allegations in it that I feel need to be examined <br />more thoroughly. One of them is whether or not that pit has been operating <br />in violation of a cease and desist. If that is true, by the law we cannot <br />issue a permit, if a violation of that cease and desist order is in fact <br />existing. We don't know, we see the pictures, we don't have the photographer <br />here. <br />WAYNE SMITH; You are going to consider that, but if you read your own rules, those <br />objections should come within 20 days of the final publication and the <br />operators should receive a copy within ten days of the date that it is <br />received. I got a copy 20 minutes ago. <br />(inaudible, several voices.) <br />JOHN WARD: Make the objections available. <br />DAVE SHELTON: Which is all the more reason why we need the special meeting. <br />JOHN WARD: We have to make those findings. <br />SHERMAN BLACH: So you have asked for a continuance. <br />DICK WARD: Mr. Chairman, I would move that at the request of the operator, Weld County, <br />File No. 80-149 be continued until the next meeting or if required that <br />the Board make effort to provide a special meeting if needed. <br />DAVE SHELTON: The objectors will be notified , <br />SHERNAN RLACH: Second. <br />JOHN WARD: I think we should ask Lew how we are going treat, if these objections are <br />did not follow the process of timely file. <br />LARRY BROWN: They may not be objections, I don't know whether they are objections to the <br />operation or if they are allegations of a violation and they can come fn <br />at auy time. Herc is one question I would like Brad to pursue while he is <br />processing, this is discussion on the motion, this application, please <br />determine for yourself make a recommendation to us about the possibility <br />of permitting an operation that is going to create harm to an adjacent <br />property owner. We cannot do that. If the end result of this gravel pit <br />is a probable course change in the river that is going to wash away somebody <br />else's land, we cannot permit the operation. <br />BRAD JAMES: I've been working on that. <br />LARRY BROWN: Do you Have an opinion on that? <br />BRAD JAMES: Yes, there is a problem. <br />LARRY BROWN: Ok, I will, certainly want that if I am at that meeting. <br />JOHN WARD: Call for the Vote.
