May 23, 1996 <br />to comply, we must gain access to the property, and determine the composition and <br />extent of the material comprising the stained areas, to make a determination as to <br />proper disposal. <br />We do not believe that the stains consist of anything other than the products, namely <br />petroleum, antifreeze and lubricants, that were used on the equipment at the quarry, <br />which sat at the stained area until last year. However, if testing were to establish <br />that some of this material must be disposed as hazardous or industrial waste, then it <br />would be necessary to profile the waste to have it accepted by a suitable waste <br />disposal facility. Further, the amount of material to be transported and disposed <br />would have to be quantified. We would have to await notification of acceptance by <br />the facility, scheduling of a truck, etc., and again gain access to the area to remove <br />the stained soils. <br />Until BLM allows Mid-Continent access to the quarry, we cannot determine the <br />content, nor the depth and extent, of the spills, nor can we clean and properly <br />dispose of the stained material. <br />The drums and containers have been removed from the quarry and placed at the <br />Carbondale load-out facility, in the warehouse. They have been segregated and, as <br />noted in the Inspection Report, "impounded" by BLM. At the time BLM sampled the <br />stained soils I inquired of Alan Kraus, who took the samples, as to whether he <br />wanted to sample to determine the contents of the drums and containers previously <br />at the site. He said he was only prepared to collect soil samples. I understood him <br />to say that BLM usually relies on the Grand Junction Fire Department to do such <br />sampling [as contents of the drums]. To my knowledge, no sampling or tests of the <br />drums has been conducted. <br />Inventory of Drums. Containers <br />(10) empty drums <br />(5) contain fluid, as follows: <br />• diesel fuel (1 drum) <br />• oil (1 drum, possibly used and drained) <br />• oil (1 drum, apparently new I£ unused) <br />• grease (2 30 Ib. pails, (1 full, 1 has approx. 1" material at the bottom) <br />• hydraulic fluid (2 5-gal. containers) <br />Labels noted: <br />• 1540 motor oil (3 drums) <br />
